The majority of these drivers are young Timorese, and it is only logical to assume that their irresponsible driving is a product of intoxication. Timorese youth engaging in this behavior show no respect for authority, and exhibit a blatant disregard for the rule of law and for the safety of those around them. Even more troublesome is the fact that this attitude seems to be prevalent in not only Dili but in the districts as well, where the jails are filled to capacity during the holiday season with young Timorese.

This spike in public intoxication and drunk driving has occurred despite an increase in police patrols and checkpoint stops. This effort appears to have done little to dissuade Timorese from engaging in unlawful behavior, and highlights the need for further action by the police force to put more officers on duty and enforce restrictions more strictly to make roads safe for travelers.

More must also be done to tackle this problem from a preventative framework to encourage youth to engage in responsible drinking habits and behaviors. Fundasaun Mahein urges the government and relevant institutions to implement programs targeting Timorese youth on responsible drinking practices.

Fundasaun Mahein (FM) implores all motorists and pedestrians using the roads during the holiday season to exercise extra caution and vigilance. Extreme caution should be taken when traveling on the night of New Year’s Eve. FM also urges partygoers to drink responsibly, and to not get onto a motorbike or into a car if the driver is intoxicated. Similarly, do not let friends drive drunk.

FM also recommends that the government launch a responsible drinking campaign before the 2014 holiday season begins. This campaign should be coupled with more stringent drinking laws; specifically, the passage of an underage drinking law as well as better enforcement of Timor’s current drinking and driving legislation.

Up-date for security situation in Timor Leste: National stability attempt in the beginning of 2014

Mahein Foundation is a civil society organization which is makes its legal profession by monitoring and doing research for the security and defense issues in terms of politic, legislation and funds for security and defense institution in Timor-Leste. In the beginning of the New Year Mahein Foundation will make a study concerning violence and crime cases that happened during Christmas 2013 and New Year 2014 periods.

After Christmas’ holidays 2013 and New Year 2014. Mahein Foundation will continue to monitor for security safety in Timor-Leste generally. Mahein Foundation’s monitoring has gathered problems that happened during Christmas and New Year periods particularly crime and violence cases. Based on the study has described such following cases that are people killed each other, young people attacked each other and also against police including unknown people who attacked some police members. It means that various crime and violence cases occurred during Christmas and New Year holidays which is considering as a national stability attempt for 2014 even though those cases are in small levels.

Such security problems that happening in the beginning of Christmas and New Year periods are, on 29 Decembers 2013 in Baucau,Baguia sub-district a PNTL member sergeant Armindo da Cruz was attacked by unknown people. A young man killed by PNTL in Balibo on 3 January 2013. Unknown people killed a young man in Becora Bridge on 4 January 2014. And some police member who threatened some young people with pistol in Bobonaro district and other cases are physical aggression in Dili city during Christmas and New Year periods.

Mahein Foundation’s analyses that, those (crimes and violence) cases which is happening in the beginning of 2014 is the causes of social injustice, which is shown big weakness of the security area. Late of Justice Process as well as weak application of the law itself will provoke tension of the conflict becomes reality. Those (Crime and violence) cases that always occurred have provoked authorities to pay attention for. However the competent authorities do not pay maximum attention for those cases and the prevention mechanism that goes very slow and still fail.

Those (crime and violence) acts that happening in the beginning of 2014 is like a step of chance by starting violence and crime for this (2014) new period in the future. If leaders of the nation and the security authorities do not make adequate prevention it will create very complexity problems in the future. The problems become high if we do not resolve the current problems that are happening.

Mahein Foundation’s point of view is needed to make security evaluation periodically and regularly for the security situation as well as performance of security authors particularly PNTL-F-FDTL members to maintain duties professionally based on democratic values.

PNTL Legal Procedure Violations

Fundasaun Mahein’s monitoring of the National Police of Timor-Leste (PNTL) has indicated the PNTL is responsible for numerous cases of injury or death to Timorese citizens. Cases where Timorese citizens fall victim to PNTL actions are not uncommon and have often been the case for public debate. In particular, the professionalism of the PNTL has come under secrutiny as their actions are not always in line with legal procedure as outlined in the Standard Operating Procedure (SOP). The unlawful acts perpetrated by the PNTL have a devastating effect not only on the public’s perception of the PNTL but also on all the security sector institutions operating in Timor-Leste.

The following are confirmed cases of unlawful acts committed by PNTL officers:

• On 3rd January 2014, a PNTL officer from the Atabae police station killed a young man about 200 meters from the crime scene of a murder the young man had committed and was trying to escape from

• On 31st December 2013, a PNTL officer stationed in Maliana threatened a crowd of people with his pistol because they were stepping over a football field line which spectators are forbidden to pass.

The cases mentioned above indicate that many PNTL officers are not fulfilling their duties in line with SOP regulations.

If cases of police misconduct are linked, they point to a larger pattern of PNTL officers violating SOP and PLAN rules. Instead of immediately responding with force, which in one case led to the fatal shooting of a suspect, officers should first arrest and detain suspects involved with a crime so that further investigation may be conducted and the proper legal channels may be followed. In the case of the 3 January 2014 fatal shooting incident, the officer who shot the suspect had no justification for doing so as the suspect had no weapon on him at the time.

FM suggests that when police deal with criminals, they must obey the SOP regulations, which are based on the PLAN spectrum: Proportional, Legal, Accountable, Necessary.

The following are some important points that must be considered by PNTL officers:

• When the PNTL officers respond to problems they should not use force immediately, but should instead respond in a professional manner to resolve the conflict or situation with as little force necessary, strictly adhering to legal guidelines in the process.

• The police should act proportionally to the situation they are in, meaning that they should be authorized to use force only if they are in a situation in which there life is in immediate danger.

• All PNTL actions must be based on legality and accountability, which means that officers cannot use force without justification, but are authorized to use deadly force only in certain situations (such as to save the life of an innocent person).

Furthermore, the unauthorized detainment of 8 people by a PNTL officer from the Lacluta police station in Viqueque district, on 16 December 2013, is another example of protocol violation by the PNTL.

This incident resulted from the fact that the detention process used by PNTL officers is sometimes not based on facts but rather on personal biases.

FM’s monitoring, particularly towards the end of 2013 and the beginning of 2014 has unveiled that PNTL actions in the field often are not based on SOP and PLAN protocol.

FM recommends that the PNTL align their field actions with SOP and PLAN guidelines so that the dream of a professional and trusted police force can become a reality in Timor-Leste.

Is Prison a Place of Social Reintegration?

Mahein’s Voice. No. 67 analyses whether or not prison is a place of social reintegration. According to decree law No. 05/2013, Directorate of the National Services of Prison and Social Reinsertion (DNSPSR), prisons are meant to enact rule of law and provide management and a security system along with social reintegration services; with the principal mission being to strengthen the necessary mechanisms in order to apply a prison system that is considered humane, fair and secure.

Historically, prisons in Timor-Leste are full of bad practices against people. Bad practices against people existed even before the Portuguese entered Timor-Leste, such as slaves who were meant only to serve kings. If slaves did not perform well, they would face grave consequences and various forms of torture. Before Portugal entered Timor, the philosophy of the prison is a place to stop or detain people who make mistakes. Prison during the colonial period, however, was practically a criminal institution itself, because the prisoners always received unjust treatment and even torture at the hands of the security guards.

During Indonesia’s occupation from 1975-1999, and the elder brother’s period of struggle between political parties attacking each other, many were arrested and detained in prison for torture. Sympathizers and militants of political parties fell victim to this. Bad treatment continued to be enacted by Indonesia’s military and security forces. The Indonesian authorities arrested thousands of Timorese. They were tortured in prison and many acts of sexual violence were committed against women.

FM’s monitoring shows that prison violence has occurred after the Independence period, and there have been many cases of physical abuse of prisoners by guards while the prisoners were detained in prison. Many unpublicized incidents have taken place behind the secrecy of prison walls, such as the case of Feliz de Jesus, who was physically attacked by 3 prison guards while detained.

Fundasaun Mahein’s recommendations:

1. Recommend to the National Parliament Committee A to conduct supervision for the prisoners in Timor-Leste and monitor what takes place in prisons and the condition of the prisons. This oversight should aim to ensure that prisons serve a social reintegration purpose, and are not centers for torture or abuse.

2. Recommend to the Ministry of Justice through the Directorate of the National Services for Prisoner and Social Reinsertion to provide adequate training for prison guards, particularly regarding responsibility, to ensure that prison guards do not violate prisoner’s rights.

3. Recommend to the Ministry of Justice through the directorate of the National Services for Prisoner and Social Reinsertion to support a constructive mentality for detained prisoners during their sentence in order to transform or influence their criminal tendencies towards civic participation before they are re-integrated to their community.

Sexual Violence Continues to Rise Amidst Government Inaction

This past week, reports surfaced that a mother and her daughter were raped before being killed and thrown into the ocean at Area Branca. Fundasaun Mahein (FM) received reports that there were at least three men involved in the targeted attack, at least one of whom was a taxi driver. In a separate incident taking place on the 21st of January, a 12 year-old girl was raped in Comoro by an older man. The victim took her case to the police, but authorities have still not apprehended the perpetrator.

These incidents are just the latest in a growing and increasingly worrisome trend of violence targeted against women and children in Timor-Leste. It is not the first time Fundasaun Mahein has reported on this trend, nor is it the first time sexual violence has been linked to taxi drivers in Timor. This past August FM published a blog post examining the relationship between growing organized crime and sexual violence in Timor-Leste. One of the cases cited was the abduction and gang-rape of a woman taking a taxi in the area of the US embassy.

Another troubling aspect of violent crimes in Timor-Leste is the increasingly accepted trend of publicly posting pictures of victims to social media sites like Facebook. In the wake of this recent case involving the deaths of a mother and her daughter, there has been widespread dissemination of pictures and personal information about the two victims on the Internet. This practice is unacceptable. It is a breach of victim privacy and could also potentially affect the investigation of the crime.

Fundasaun Mahein asserts that the Ministry of Justice should publicly address this issue and work to prevent people from posting pictures of victims. At the very least, the public should be encouraged to only publicize pictures with censored identities (blurred or black-out faces). In addition, the Ministry of Justice should do more to provide public acknowledgement and information on violent crimes, especially for highly publicized cases. A steady and transparent stream of information from a respected and credible source like the Ministry of Justice will help to dispel rumors, and will deter people from feeling the need to post personal information of victims on social media sites.

The rise of sexual violence can be viewed as a byproduct of a more prevalent cultural attitude that marginalizes women in Timor-Leste. It is imperative that the government does everything in its power to reverse this pattern and protect the women and children of this nation. Female leaders in the government should lead the charge to push reform for women’s rights and protections. These reforms must include increasing the capacity for law enforcement to investigate and successfully prosecute sexual and violent offenders.

FM also recommends that specific legislation be passed to address the unregulated taxi industry in Timor-Leste. If the government wants its citizens to feel safe using taxis, it should take more steps to ensure that drivers have no criminal history or connections to organized crime.

Polisia Nasional Timor-Leste (PNTL)

This week the PNTL released its strategic activity plan for the years 2014-2018. In this release, entitled “PNTL Business (Activity) Plan 2014-2018”, the PNTL provides a comprehensive overview of its organizational goals and activities for the upcoming five years. Among the topics covered are the PNTL’s vision, mission, principles, motto, and the strategic direction and objectives for 2014-2018 as defined by the RDTL government. The strategic plan also reinforces the PNTL’s “VIP” policing model, which advocates for visibility, involvement, and professionalism in every PNTL activity.
Fundasaun Mahein (FM) welcomes the transparent release of this plan, and is happy that the PNTL has invited FM to participate in the launch of the 2014-2018 strategic plan.

The PNTL Business Plan highlights four specific priorities:
1. Budget, Finance, and Administration
2. Community Policing
3. Traffic and Road Safety
4. Crime Prevention, Investigation and Intelligence

These priorities will be highlighted within the implementation of the PNTL’s two core objectives: reforming and developing the PNTL institution, and the consolidation of public order and community security. FM views the PNTL’s objective of reform and development  which calls for the prioritization of budget, finance, and administration  as particularly crucial to the organization’s success. More specifically, the PNTL strategic plan mentions “Delivering financial and administrative strategies to manage the human and physical resources of the PNTL.”

FM applauds the attention to detail and close thought that the PNTL has put into the creation of the 2014-2018 strategic plan. FM also welcomes the report’s transparent release, and is happy that the PNTL has invited FM to participate in the plan’s launch.

At the same time, it is important to remember that any plan unaccompanied by resources or action is destined to fail. The creation and release of the 2014-2018 strategic plan is a step in the right direction, but the PNTL must now prepare to tackle the much more difficult task of successfully implementing the activities it has promised to carry out. FM hopes that the multitude of key activities specified in the 2014-2018 Business Plan will be carried out, and that all PNTL members will act in unison to abide by and seek to achieve the goals and activities set out in the plan. It is of utmost importance that PNTL officers take the goals outlined in the strategic plan seriously. It is also important that the PNTL works to ensure accurate and transparent self-assessment of its successes and failures to implement its planned activities over the next five years.

As a civil society organization monitoring the security sector, FM will do its part to ensure that the PNTL is held to the standard that it has set for itself. Timor-Leste Strikes Troubling New Weapons Deal with Indonesia

On Monday (February 10, 2014) Timorese Prime Minister and Defense Minister Xanana Gusmao met with Indonesian Defense Minister Poernomo Yusgiantoro to sign a defense memorandum of understanding meant to boost security and defense ties between the two nations. One major provision of the agreement is Timor-Leste’s intention to purchase more weapons from the Indonesian state-owned defense corporation PT. Pindad

This deal is just the latest in Timor-Leste’s increasing reliance on Indonesia for military equipment. In 2012 Timor-Leste made a large-scale weapons purchase from PT. Pindad in a backroom deal that turned out poorly; the weapons produced by the Indonesian company were of poor quality and many malfunctioned after only limited use. In the same year, the government also planned to purchase tanks and armored personnel carriers from the same company. Once again the process lacked transparency and reports surfaced that the military vehicles were of poor quality.

Fundasaun Mahein (FM) is troubled by Timor-Leste’s growing dependence on Indonesia for military supplies. Allowing Indonesia to become Timor-Leste’s primary weapons supplier is a bad decision for a number of reasons. The first reason is simply that the products produced by the PT. Pindad company are of very suspicious quality. Why would Timor-Leste continue to do business with a company that has already sold us malfunctioning and substandard military equipment?

It is also important to note that weapons produced by PT. Pindad have fallen into the hands of terrorist groups operating in Indonesia as well as in Mindanao, Phillipines. Whether or not these groups received these weapons because of the company’s negligence in screening its customers is unclear. Regardless, the apparently vast availability of these weapons presents a security threat to Timor-Leste. Ascertaining responsibility for violence will be more difficult if both Timorese security forces and criminal or terrorist factions are using the same weapons.

This security threat is heightened further when considering the dismal track record Timorese defense forces have displayed for controlling their own weapons. Despite numerous cases of weapons abuse and weapons “misplacement” by security force members, Timor-Leste still has yet to implement a weapons control and auditing system to monitor the weapons it purchases. Without such a safeguard, there is always the threat that weapons will be misused or fall into the wrong hands.

FM also questions the morality of buying weapons from a military that was very recently responsible for numerous acts of atrocity against the people of Timor-Leste. Many of the same soldiers and leaders responsible for human rights abuses against the people of Timor during the Indonesian occupation are still in the Indonesian army, and continue to be promoted through the ranks with the full support of the Indonesian army. A couple of the more high profile acts committed by Indonesian soldiers include the 1978 assassination of Timor’s beloved late President Nicolau Lobato, and the infamous Santa Cruz massacre in 1991. The perpetrators never received justice. Furthermore, to this day the Indonesian Army refuses to return the bodily remains of Nicolau Lobato to his homeland to be buried where he belongs.

How can the Timorese government, in good faith, purchase weapons from an army responsible for decades of suppression and subjugation of its people? Have our leaders already forgotten about the injustices committed against the Timorese people at the hands of the Indonesian army? Of course Timor-Leste should put past conflicts behind it, but FM maintains that the future should be written in an honorable way, with respect and consideration for the recent history of this nation.

It is unthinkable that the perpetrators of human rights abuses against our nation should now make profits at the expense of the Timorese people. Surely Timor-Leste can pursue far better options in its weapons procurement search than PT. Pindad. FM urges the government and the Ministry of Defense to seek out another weapons supplier who can provide high-quality weapons and a true partnership with Timorese defense forces.

Scope and Severity of PNTL’s Regulation Violations

Fundasaun Mahein’s Voice report No.70 discusses regulations violations committed by the PNTL during field operations. These infractions have become a cause for concern for community members who question the PNTL’s professionalism and capacity to fulfill its role of upholding the law and maintaining order.

The objective of this report is to analyze PNTL violations in relation to the laws and regulations of the PNTL. Such analysis is necessary to understanding the ways in which PNTL officers can better conduct their activities, when it is appropriate for them to use force, the amount of force they should use, and the level of accountability officers should be held to for their actions.

According to FM’s monitoring, many PNTL activities are not conducted in accordance with the PNTL’s “Standard Operational Procedure”, especially in regards to policies highlighting the use of force. There are strong indications that PNTL members have broken laws in numerous instances. To highlight a few examples, a young man was shot to death in Balibo by a PNTL officer in 2014, a PNTL Task Force member physically assaulted a deputy of the National Parliament in Audian-Dili in 2013, and in 2012 a PNTL member from Becora shot and killed a young man to death in Hera.

These three cases in particular have raised legitimate concerns from the public regarding the professionalism and competence of the PNTL. These cases are major blows to the public’s perception and trust in the PNTL as a law enforcement organization. Another consequence is that some PNTL members have become criminal suspects as a result of their actions, which violated PNTL laws and regulations.

In response to this issue, FM recommends that the Secretary of State for Security (SES) and the General Command of the PNTL re-assess the training regimen for PNTL officers. Training should be intensified and should include an increased focus on upholding the law and human rights, as well as a clear understanding of when and how the use of force is permitted, especially by the Special Police Unit (SPU) and Task Force.

Obedience and Discipline in the PNTL and F-FDTL

Mahein’s Voice report No.71 examines the levels of obedience and discipline exhibited by members of the PNTL and F-FDTL. Analyzing these aspects allows for a greater understanding of the capabilities of the PNTL and F-FDTL as institutions.

Although both organizations have policies and regulations in place, some PNTL and F-FDTL members choose to ignore their mandate. Violations that have been committed include provocations and physical altercations at bars. Such incidents are frowned upon heavily by community members, and pose a retribution threat by people seeking to attack military and police members when they are off-duty.

FM’s monitoring has identified numerous incidents in which disputes between civilians and police or military officers led to violence. In some cases that have yet to be solved, unidentified attackers killed PNTL and F-FDTL members. One such case took place in 2012, when unidentified perpetrators attacked a F-FDTL member. He died in the National Hospital Guido Valadares. In another case in 2012, a PNTL officer was attacked and killed by an unidentified group in Tashilin village, in the Zumalai sub-district of Covalima.

In response to this problem, FM urges the government to prioritize a policy response to this declining discipline, and to continue to develop human resources in security sector institutions. In addition, strong penalties must be enacted against PNTL and F-FDTL members who do not obey disciplinary protocol and regulations.

Fundasaun Mahein’s Recommendations:

1. Recommend to the Ministry of Defense and Security through the Secretary of State for Defense and Security to create a mechanism for political control over the development of the PNTL and F-FDTL institutions, particularly in the area of human resources, which would have a positive impact on the mentality of the members.

2. Recommend that the command of the PNTL and F-FDTL strengthen disciplinary measures to ensure that PNTL and F-FDTL members who break regulations are punished accordingly.

Success of Mobile Response Stations Vital to Crime Reduction in Dili

This week the PNTL released its national crime statistics for the year 2013. The chart reports a total of 3,032 incidents of crime during the past year, encompassing categories ranging from corruption to murder. Crime was clearly concentrated in the nation’s capital, with Dili accounting for 35% of national crime incidents (1,068 recorded events). Among the more prominent crime categories occurring in Dili were 17 murders (out of 52 nationwide), 420 cases of physical assault (out of 1,275 nationwide), 155 cases of spousal abuse (out of 744 nationwide), and 96 cases of brutal demage (out of 194 nationwide). These inflated figures solidify Dili’s place as the “conflict” of Timor-Leste.

The high Dili crime rates were reported amidst the recent launch of the PNTL’s “mobile response station” initiative. This new policy became functional on the 21st of February, and aims to create an integrated action response to all forms of security or public safety threats including crime, traffic accidents, and community disturbances. As part of the policy, six PNTL cars have been designated to cover various sections of Dili (East, Central, West, etc.). The cars will be manned and on-call 24 hours to provide immediate response to emergency situations. This policy reflects the PNTL’s growing focus on “responsive policing”, the idea being that community members can call their local PNTL center at any time to request immediate assistance.

The need for a PNTL focus on responsive policing is painfully apparent, as was demonstrated in the tragic death of a young man just last week. The young man in question was killed in front of the Foreign affairs building at Beach Road Dili on 23 Feb 2014. Despite the fact that the murder took place in a busy area not far from where numerous PNTL officers are stationed, it took police officers over an hour to arrive at the scene of the crime. This is simply unacceptable, as an hour-long response window makes it almost impossible for police to gather suspects or credible witness.

While the PNTL’s new policy is certainly a step in the right direction, the PNTL has done very little, if anything, to inform the public of this new service being offered to them. The launch of the program was not publicized in any national media sources, including television or radio. How can mobile response stations be utilized successfully if the majority of the public remains unaware of their existence?

FM is confident that mobile response stations can serve as an integral component of crime reduction efforts in Dili. If implemented correctly, they will offer a vital responsive policing mechanism that will empower Timorese citizens and deter criminal offenders. The PNTL must now do more to publicize its new service so that the public is aware of the mobile response stations and how to use them. It is also essential that the PNTL work diligently to ensure that the quality of the program and the response times of stations will improve consistently.

Underage Drivers and Perilous Road Conditions in Dili

This past Sunday, the 23rd of February, an underage driver hit and killed a Timorese woman on the streets of Dili. This incident is just the latest reminder of the hazards that underage drivers present to road safety in Dili. The presence of underage youth operating motor vehicles in the capital city seems to be increasingly common occurrence. Many of these drivers lack training and experience, drive recklessly, and display a blatant disregard for other vehicles and the rules of the road (such as the proper use of directional blinkers). Furthermore, the convergence of youth migration to Dili coupled with an increase in the rate of underage drivers in the city is a troubling indication of things to come.

According to PNTL statistics, Dili recorded a total of 994 traffic accidents in 2013, accounting for 64% of the 1,534 total recorded traffic accidents in Timor-Leste. PNTL records also show that accidents in Dili resulted in 557 minor injuries (out of 1,228 nationwide), 95 serious injuries (out 328 nationwide), and 32 fatalities (out 73 nationwide). These figures establish Dili’s standing as the city with the most dangerous road conditions in Timor-Leste.

Although there are currently no statistics available to support the claim that underage drivers are the main cause of hazardous roads in Dili, the high rate of youths in Dili indicates that there may be a correlation between young drivers and increased accident rates in the city. If the problem of underage drivers is left unchecked, Dili’s alarming road conditions will only continue to get worse. FM implores the government and the PNTL to formulate policy in response to this problem, to ensure that driving age legislation is enforced effectively and comprehensively.
