Candidate and Nomination for the PNTL General Command

This report will discuss about the candidate and the nomination of the new PNTL general command after the nomination of the former PNTL general command Longuinos Monteiro to be the minister of interior for the sixth (VI) constitutional government in 2015. It has left a big gap inside the PNTL and no-one has been anyone nominated for the position yet.

The discussion for this nomination of the new PNTL general command up to this point has been whether the new PNTL general will come from the national parliament or from civil society. This has been resolved that the proposed candidate for the PNTL general command should come from the PNTL institution and not civilian institutions.

As shown after the crisis in 2006, when the government nominated an important legal prosecutor, but received strong criticisms from the national parliament and civil societies. Ironically members of the PNTL were really concerned with such nomination because they were worried about a civilian leading the PNTL institution.

Therefore, FM suggests that the PNTL has for 15 years produced professionalism, academic and work experience thus far, so the candidate for the PNTL general command should from PNTL itself. Yet it needs to consider that a figure which is nominated for this position should pose high integrity and credibility to lead the institution.

So in order to get a high integrity and credible figure it needs public views and involvement in the process. Institutions such as the national parliament committee B, even though it is not mandated to be part of the process, need to be involved in order to get public legitimacy.

On the other side, the Commission of Anti Corruption (CAC) and the Public Ministry also need to be strongly involved. The purpose of these components involvement is to see over the track record on the criminal cases such as corruption and other case, and need to apply the performance evaluation to the PNTL members in the selection process for the candidate of the new PNTL general command.

Finally, the main agenda for the new PNTL general command to continue implementing past measures such as the PNTL strategic plan for 2014-2018.

Recommendations

1. Recommends to the Ministry of Interior that the selection process involves KAK and the Public Ministry over the criminal record of the figure who is the candidate for the PNTL general command.

2.The nominated candidate is the PNTL general command from the council of minister needs to declare his/her assets to KAK.

Assault PNTL in Baguia: Provoke Response for the Policy of Re-collecting Arms

Over the past seven years the government of Timor-Leste has issued many resolutions to authorize The National Police of Timor-Leste (PNTL), and the FALINTIL Defense Force of Timor-Leste (F-FDTL) to search and re-collect those military armaments that have gone missing. These has included items as; uniforms, weapons, grenades and many other things that are still circulating around villages and communities, in particular PNTL weapons that have been missing since the 2006 crisis. For example, at the end of 2014 the Council of Ministers issued a resolution for the collecting the military arms, asked veterans and members of clandestine groups to hand over these weapons, (Read here www.thetimornews.com).

The recent incident in Baguia, where an unknown group threw grenades at a PNTL station, injuring four police officers, shows strong evidence that the implementation of re-collecting armaments in Timor-Leste is still a problem, (www.diariutimorpost.tl). This is in spite of the many years that the security authorities have been attempting to re-collect these illegal arms that many still seem to have been able to keep.

Many statements have been made by leaders of the defense and security institutions on the progress that they have made re-collecting these weapons but so far there is no concrete proof to back up these claims. The National Parliament itself continues to ask for evidence of the outcomes that have resulted from the re-collection of these weapons (www.thetimornews.com) confusing the public about the process itself.

Are the security forces serious in their attempts to search and re-collecting these military arms? This question continues resounds in the thoughts of many circles in Timor-Leste’s but is yet to receive a clear response. Also why are the security forces finding it so hard to search and re-collect these illegal arms? Is it because they are distrusted because of the intelligence service’s failures?

FM believes that this needs attention by the sixth (VI) government and for it to use its mandate to pursue this matter. By reviewing the policies of re-collecting the military armaments, in order to respond for the public’s concerns, could lead to the reduction of any incidences of violence by civilians using military equipment to destroy the national stability.

With this FM urges the Ministry of Defense and the Ministry of Interior to strengthen their co-operation and to design a new policy to re-collect missing military armaments during 2006. We also implore these agencies to create a national inventory of Military and Police armaments and to educate the public about the types and amount of weapons still missing so that public are able help the authorities in the collection of these weapons. FM urges the government to continue creating capacity and providing sufficient facilities for the national intelligence service to facilitate the information process.

The Joint Operation: A Bad Practice for the Security Sector

Timor-Leste recently launched the HANITA Operation, the sixth conjoint operation since independence. This practice has become a bad habit of political aggression, used in response to any incident threatening national security. The past five operations all possessed their own-mandates. This new HANITA initiative is led by the rising generation of young leaders within the security sector. The HANITA Operation presents a predicament that these young leaders must solve.

On 11th March 2015, the Council Ministry approved a resolution in response to the actions of illegal groups that took place on March 8th, 2015. These groups have been accused of involvement in organized crime, set in motion to instigate unrest in Timor-Leste. Resolution No.11/2015, issued by the Council Ministry, is designed to prevent and repress the actions of these criminal groups. The government holds the right to organize cooperative missions between the defense and security forces, according to Law No. 2/2010, National Security Law No. 3: Article 36.

On 21st March 2015, the government launched the team of defense and security forces to address the criminal groups. Fundasaun Mahein expresses its strong support for this operation as a means of strengthening law and order within this nation. This operation is the appropriate response to any provocation or aggravation of the public order. However, the operation should follow the protocol established by national security law, and performance law, as well as the fundamental rights protected by the Constitution.

Throughout this country’s history, conjoint operations have become politically aggressive in nature. This seems to signify that we are strongly investing in war rather than peace. Also neglected is the importance of the justice sector, as evidenced by the prevalence of conjoint operations in solving all matters, big and small.

As such, Timor-Leste should establish a national security policy that responds appropriately to today’s threats. This means not relying upon conjoint operations of security and defense forces to solve every situation. National security law, as it currently stands, establishes clear boundaries, which are enforced by the Integrated National Security System (NSIS).

Recommandations

1. Use force as necessary and in coordination with security laws

2. Obey the laws governing operations

3. Updates on Operation HANITA should be presented to the President of the Republic every week as the Supreme Commander of Army Forces

4. Reports regarding the operation should be presented to the National Parliament, outlining the security situation and finances

5. The public should be informed about the operation and the security situation by the national media

6. The public should act as facilitators of the operation and present cases of misconduct, poor discipline, and constitutional infraction to the commander of the conjoint operation and the relevant judicial authorities.

Do people with a disability have equal rights to safety and justice in Timor-Leste?

Fundasaun Mahein (FM) has recently heard of a case involving a woman with disability (mental illness) from rural Timor who allegedly experienced sexual abuse. Despite the support of her family and a local disability NGO to bring the case to the attention of the PNTL, the police refused to begin investigating the crime because they found her evidence “weak”. The woman was advised instead to go and seek treatment for her illness before she could re-lodge the complaint. The woman’s family and NGO are angry that the police did not take the woman seriously because of her disability.

The case illustrates discrimination in that the PNTL did not apply the same response for a person with a disability as they would a citizen without a disability. FM is aware of stories involving crimes against people with a disability with similar problems accessing justice.

Officially 48,243 people have a disability in Timor-Leste although many people consider an unofficial estimate of 176,400 a more accurate number. Certainly, people with disability live throughout all districts and areas of the country.

Although the Constitution specifically provides that a disabled citizen ‘shall enjoy the same rights as all other citizens’, the ability of the nation to uphold this right is questionable where, for example, 72 per cent of people with disability have never attended school.

In terms of the Justice System, International research indicates that people with intellectual, cognitive or developmental disabilities get involved as both victims and suspects/offenders of crime far more often than individuals without disabilities.

The high involvement of people with disability as suspects/offenders is partly due to the fact that they may not understand that they are involved in criminal activity and/or are often easy to manipulate and “befriend” by criminals.

In terms of victimization, a UN Report indicates that rate of assault (e.g. rape, sexual assault, aggravated assault) for people with disability in Timor is nearly three times the rate among persons without disabilities (this rate is consistent with statistics in other countries such as the US).

Because of this high number of people with disability that will interact with the PNTL across Timor as either victims or suspects, it is essential that police officers are adequately trained to understand and uphold their basic rights of safety and justice.

Since 2000 UN Police and then the PNTL has had a specific Vulnerable Persons Unit (VPU) to ensure that victims of sexual abuse, domestic violence, children, the disabled, and others who require a different policing approach are adequately cared for. Despite its good intention the VPU is understaffed and resourced, and focused mainly on the issue of domestic gender-based violence.

Due to these resourcing issues it is inevitably regular and not specialized police officers that will respond to incidents involving people with disability (as in the case outlined above). Regular police do not receive any basic training regarding disability and so it is more than likely that their response will not properly support people with disability or uphold their rights. Indeed this exact problem was identified by the PNTL themselves four years ago in a UNHR Report which stated, “Police specifically indicated a need for training for non-VPU officers, on methods to work with victims or suspects who have mental or physical disabilities.”

The PNTL Strategic Plan 2014-18 acknowledges the need to improve the capacity of operational police to protect vulnerable citizens, however, it does not specifically address the issue of disability. FM believes that due to the extent of interaction between people with disability and the PNTL, without such a strategy the PNTL is in breach of its stated mission to “Defend the rights and liberties of citizens and strengthen the mandate of the Constitution”.

FM therefore recommends as a matter of urgency that the:

1. PNTL start a dialogue with national disability organizations in order to develop a strategy to improve the interaction between people with disability and the police.

2. PNTL to enact mandatory basic training for all current and future officers on the rights of people with a disability, and to establish mandatory processes and standards for dealing with both victims and suspects with a disability.

3. PNTL to monitor, investigate and take appropriate action against police officers who do not uphold the human rights of people with disability.

Timor-Leste at the Mercy of Rumors

Since independence, the security of Timor-Leste has been threatened by the rapid spread of damaging rumors; most notably the crisis of 2006, where the communication network of Timor Telkom was shut off completely, and the general public was getting their information entirely by word of mouth. The prevalence of inflammatory rumors has only served to stir conflict in Timor-Leste—causing unnecessary damage and creating many victims.

After the crisis, Timor-Leste is now consolidating peace and public safety. However, Timorese society remains vulnerable to rumors. Unfortunately, the security institution is influenced by rumors as well. Of particular concern is are the rumors surrounding the operation against the Maubere Revolutionary Council (CMV), where there is a disturbing lack of accurate information available to the public.

As it happens, on 14th March 2015, the FALINTIL Defense Force of Timor-Leste (F-FDTL) sent military units to operate in the area of Remexio Sub-district of Aileu District. This decision was based on rumors of more than a hundred members of CMV operating in the area. There were in fact no operations of CMV in Remexio. This incident demonstrates that rumors are starting to affect the defense and security apparatus of Timor-Leste.

After the launch of joint Operation HANITA, a few weeks later rumors spread on social media that the leader of CMV and some of his associates were staying in Uatukarbau Sub-district, Viqueque District. This issue received much attention in national media as well as Facebook and Twitter. Other contradictory information states that the leader of the CMV organization is now in Dili, is discussed by many residents.

The prevalence of harmful rumors has made many citizens concerned about the internal security situation and about the safety of their neighborhoods. Many questions were raised by the people regarding the position of the defense and security institutions, particularly the Conjoint Operation Command (COC), over the rumors. Fundasaun Mahein itself is concerned that there is no effort from the relevant institution to make any statement to public regarding the rumors. This means such rumors will continue to cause innocent people around the territory of Timor-Leste anxiety and trauma.

The people of Timor-Leste will continue be at the mercy of rumors if there is no concrete action taken by the government—particularly any official statement form the defense and security institutions—to respond to and clarify rumors that are now facing by the people and this sovereign state. There exists a pressing need for an adequate mechanism of the government to supply credible and fair information to its people.

Regarding the prevalence of rumors, FM recommends:

1. The Office of the President of the Council of Ministers as the spokesperson of the sixth (VI) government establishes a mechanism to respond to the spread of rumors in communities, in order to provide the public with accurate information in a timely manner.

2. The Interim Minister and Minister of Defense and Security should coordinate to supply official statements to the public over rumors of the CMV leader’s presence, and the progress of the operation HANITA, so that people are aware of internal security issues.

F-FDTL and PNTL Personnel Continue to Violate Internal Policy as well as Common Law

According to the Law of Military Discipline Chapter II Article 4 regarding the military’s responsibility, members of the military are forbidden to wear any uniform or emblem of the institution in a way that is not in compliance with legal procedure or without the recognition of the institution. According to the RDM of July 2007 and the Organic Law of the PNTL Article 5 Line 3, use or wear of the institution’s uniforms or emblem by police personnel should be based on the institution’s rules. Decree law number 09 2009 also clearly explains that it is forbidden for members of the police and military to use or wear the institutions’ emblems for their private interest.

However, the fact that some members of the F-FDTL and the PNTL use the emblems illegally on their private vehicles has garnered much attention and has been frequently discussed in the past few weeks. Fundasaun Mahein (FM) identified that irresponsible behavior of the military and police members in misusing the institutions’ materials is increasing—especially with regards to the use the institutions’ emblems in their private vehicles, and the misuse of weapons.

FM also identified that some members of these institutions (F-FDTL-PNTL) sometimes wear their uniforms while racing motorbikes, driving the vehicles at unsafe speeds, and drive their motorbikes on public roads without wearing helmets. There has also been a number of incidents between members of the Traffic Department and the Directorate of Transportation and Land when conducting check-points.

These irresponsible acts are occurring on a daily basis, and have attracted the attention of the general public, which is urging a action be taken. The supreme commands PNTL and F-FDTL are themselves strongly concerned about their irresponsible members’ behavior. Indeed, those members must obey the law and rules of the institutions, particularly as they must themselves become a good example in respecting the institutions’ emblem as well as the traffic rules. (TP, 25 April 2015).

Regarding the irresponsible behavior of those members, FM believes that a stronger mechanism is required to deal with rule infractions by police and military personnel. This will strengthen the professionalism of the forces and ensure the institutions’ prestige.

Fundasaun Mahein recommends:

1. The government, particularly the national Directorate of Transport and Land (DNTT), issue a decree law in order to regulate the use of their emblems by members of the F-FDTL and PNTL in their private vehicles.

2. The Supreme Command of the two institutions (F-FDTL and PNTL) enforces a strong penalty against those undisciplined members who use the institutions’ emblems for their private interest.

3. The Military Police (PM) takes action to control members of the F-FDTL who violate the rules of the institution with regards to traffic law, in order to reduce the number of infractions committed by the military members.

FM SECURITY ALERT: MAG Violence on the Streets of Dili

This Fundasaun Mahein (FM) Security Alert warns of violence between rival Martial Arts Groups (MAG) in Dili.

Over the weekend fighting broke out between two rival Martial Art Groups (believed to be the PSHT and Kera Sakti), in the streets of Farol, Aimutin, Bebonuk and surrounding areas.

The violence has been traced to a video filmed in England of members of the rival groups fighting which resulted in one male is punched. It is believed that the fighting in Dili over the weekend began as “payback” by members of the same group as the man who was punched.

FM warns of the likelihood of ongoing street fights between the groups in and around Farol, Aimutin and Bebonuk as the PNTL are yet to take control of the situation.

All citizens and foreigners should be aware of the potential for violence in these areas, particularly at night, and take necessary measures to ensure their personal security.

Are Drugs a Serious Threat to Timor-Leste?

The threat posed by drugs to Timor-Leste has recently become a major public concern, as fears have mounted that drug use would become more widespread and threaten society and the stability of the country.

Available data shows case of drugs have been detected and captured by the authorities. From 2011 to March 2015, there have been 40 registered drug cases, with 22 cases ending in a prison sentence for the offender, with the remainder either being found not-guilty or receiving civil penalties. These cases involved both Timorese as well as foreigners consuming, selling, and distributing drugs across Timor-Leste as well as trafficking to neighboring countries. This raises concerns that Timor-Leste is becoming a transit point in the international drug trade.

Fundasaun Mahein’s (FM) monitoring reveals that drug trafficking by organized crime networks takes place through air, sea and land routes. In some instances these networks make use of shipping agencies to move their illegal products internationally. The domestic drug trade is largely handled by Timorese citizens.

Drug trafficking by members of international criminal syndicates poses the risk of growing local networks in Timor-Leste. In one example case of drug trafficking, an organized crime network shipped drugs from Africa via Singapore to Timor-Leste, before distributing to Indonesia for sale and consumption.

FM believes that Timorese security forces are not prepared to deal with drug trafficking; airports, seaports, and the land border lack the adequately trained personnel and equipment to detect and seize drug shipments. International organized crime is also aware of the security situation of Timor-Leste, and is taking advantage of the vulnerability of the nation as a transit point for their illegal activities.

Regarding local drug use, FM’s research shows that at least 64 of Timorese have been arrested for consuming illegal drugs, comprising of 57 males and 7 females. Despite the relatively small number of arrests, it is important to note that many users evade authorities’ notice, and that the large number of unemployed Timorese youth are particularly susceptible to the corruption of drugs.

FM is concerned that these individuals are vulnerable, and can be recruited by organized crime networks to become involved in drug trafficking. FM is also concerned with Indonesia’s strict laws regarding drugs, which proscribe the death penalty for drug traffickers. It has been published by international media so far this year, more than ten individuals have been executed or drug related offences in Indonesia, the majority of them foreign citizens.

Recommendations

1. FM recommends the government and the national parliament prioritize discussion of the draft law on drug trafficking and consumption.

2. FM recommends the government strengthen the monitoring of Timor-Leste’s land borders, and provide sufficient personnel and equipment to deter drug trafficking through airports and seaports.

3. FM recommends the government organize a special body tasked with investigating and prosecuting cases of drug trafficking.

4. FM recommends the government create a national commission for preventing drug use via a national campaign to alert people to dangers of drugs, as well as construct a rehabilitation facility to provide treatment to drug users.

The Security Sector Must Improve Communication With Public

From the crisis in 2006 and the ongoing Mauk Maruk (KRM) issues to recent events of gang violence and “L-7” troubles in and around Dili, the common themes in all these events has been disinformation, rumour and gossip.

The recent security history in Timor-Leste clearly shows that misinformation and gossip has the potential to spread within communities, raising fears and feelings of insecurity in peaceful citizens and inspiring and provoking some in the community to cause problems. This is a problem that Fundasaun Mahein has raised before and it is frustrating that many incidents stopped from escalating, or avoided entirely, through something as simple as better public communication.

Yet surprisingly the Polisia Nacional Timor-Leste (PNTL) appear to be retreating from this issue (the establishment of a nationally coordinated public communications system is at the bottom of 17 Administrative objectives in the PNTL Strategic Plan). The communications is perhaps best illustrated by the PNTL Facebook page, a great opportunity to communicate with many (especially young) people through an increasingly popular medium, but currently with only 7 friends and no updates. It is clear that the PNTL’s focus is very on improving (the necessary) internal communications hardware and systems, but not on speaking to the public.

It is not surprising then that the TAF Community Police Survey showed that far more people turn to the television, radio or the community to receive information about security than the PNTL. Indeed, it also showed that the police themselves are far more likely to turn to the television then their own organisation to receive such information.

But while they are Constitutionally responsible for internal security the problem of misinformation is not entirely the PNTL’s. The fact is that in a security situation no one quite knows who to turn to or believe: The Office of the President? The Ministry of the Interior? The PNTL Central Command? The PNTL District Command? Local PNTL officers? The F-FDTL? Foreign Embassies’ or INGO’s security assessments? Your boss’s and colleagues, friends and neighbours?.

To resolve this Timor’s key security agencies need to come together to initiate a framework for communicating with the public on security issues. They need to better gather, assess and coordinate intelligence between internal security organisations, and then nominate a single, centralised, focal point (spokesperson) to provide credible information to departments, organisations, officials and the general public across the entire nation. A set of protocols should include checks and balances to ensure that any communication is relevant to the threat level and will not inflame a situation. False information, rumours and gossip should also always be addressed quickly and corrected through this focal point.

A new communications strategy could also examine the most effective ways to communicate official information to the public, such as by using traditional media such as television or new mediums such as SMS or social media that is increasingly available and used by Timorese. Such a strategy could also be used in other situations such as warning and directing citizens before, during and/or after natural disasters.

FM believes that this is not a difficult or overly costly problem to overcome – rather it is one that requires only basic cooperation, organisation and partnership. It is urgent that the Government and security sector takes the lead in developing such systems as, if they fail to, past events have shown that false information will always fill this gap.

Recommendations

1. Key Security Sector Actors including the PNTL, FFDTL and Ministries prioritise the creation of a national communications plan and protocols that can quickly and effectively provide critical, clear and consistent information regarding security issues to the general public.

Policy and Realization of the Sixth (V) Constitutional Government in the Security Sector 2012-2015; “Between Success and Challenge”

Timor-Leste’s security sector policy is clearly defined in the National Development Strategic Plan (NDSP) 2011-2030.

The sub-sector policies of the NDSP are; Legislation, Human Resources, Infrastructure and Bilateral Cooperation between Timor-Leste with other foreign countries in order to develop the key institutions, PNTL and F-FDTL.

The NDSP’s Legislation Policy concerns creating a legal framework to ensure regulation for civil protection, the migration service and the continued development of internal norms and rules of the PNTL in regards with the procedure, discipline, transparency and accountability.

Despite the Policy, there is a need to further legislate and review existing laws in regards to areas such as creating a National Maritime Authority (NMA), in addition to other laws that respond to dynamic and developing issues within security institutions.

The Human Resource Policy is focused on increasing the professionalism by facilitating training for members of the PNTL in various thematic areas that correspond to the Police’s mission, recruitment and promotion.

The Infrastructure Policy is focused on equipment and facilities inside the security and defense institutions. However, the institutions of PNTL and F-FDTL still currently have relatively poor infrastructure, causing ongoing challenges in service delivery particularly by the PNTL in district areas.

The Policy of Bilateral Cooperation aims to develop the skills capacity in police and military institutions. A recent example is the partnership between Timor-Leste and Indonesia to facilitate training and information sharing regarding community policing and combating drug and human trafficking.

Bilateral cooperation between Timor-Leste with other countries is vital for the development of security and defense institutions. However, the Government is yet draw-up official memorandum of understanding agreements regarding such cooperation to ensure their ongoing sustainability (A recent example being the ad hoc agreement between the Philippines and the PNTL and F-FDTL, without an official MoU).

Recommendations

The development policy for the security sector in Timor-Leste is defined in the National Development Strategic Plan (NDSP) 2011-2030. The Government has so far implemented the NDSP in order to develop and consolidate the security sector, particularly the PNTL, F-FDTL and other relevant security institutions. However, despite some progress, this consolidation has yet to fully realize the vision outlined in the NDSP in terms of the development of infrastructure, human resources, legislation and other key areas.

1. Recommends that the VI Government continues to develop infrastructure for the PNTL and F-FDTL following suitable needs assessments and procurement processes to ensure transparency and good governance.

2. Recommends that the VI Government continues the process of strengthening regulation and training for the military and police forces’ human resources with the aim of creating a truly professional membership.

3. Recommends that the VI Government to strengthen bilateral cooperation with foreign countries by creating long-term agreements and partnerships to support and develop the security sector of Timor-Leste.

4. Recommends that the VI Government to establish a National Maritime Authority (NMA), and more importantly define a National Security Policy (NSP) in order to better implement security policy in line with the PEDN.

U.S. Marines with Company A, 1st Battalion, 4th Marine Regiment, Marine Rotational Force – Darwin, rehearse weapon presentation and four-man room clearing tactics and procedures aboard the USNS Sacagawea (T-AKE-2), June 20 in Dili, East Timor in preparation for Exercise Koa Moana 15.2.

The platoon of Marines will be conducting a bilateral exercise with the East Timor Defence Force, focusing on individual-level fundamentals to build proficiency in complex squad and platoon level tasks. The bilateral training will include room clearing of buildings, urban movement and patrolling. The MRF-D six-month deployment demonstrates how the Marine Air Ground Task Force is equipped and organized to carry out national objectives in cooperation with our national and international partners.
