Reform UN: Women in the Security Forces

Just recently on the 12th May 2014 Major General Kristin Lund of Norway was promoted to become the first ever woman to lead a UN peacekeeping operation. She will lead the UN Peacekeeping force in Cyprus. Fundasaun Mahein greets this news and would like to congratulate Major General Lund on her appointment.

Fundasaun Mahein believes getting more women into these positions of authority is a vital part in strengthening security forces, traditionally dominated by males. Too often women and children are the main victims in conflicts, powerless to change their circumstances. We see this again and again in conflicts throughout history, replayed most recently in Syria’s Civil War. Indeed some studies have even indicated that the safest place to be in a military conflict is in fact in the armed forces. This latest move and similar moves throughout the world to promote women to positions of authority in the security forces seeks to reverse this trend and empower women so as not to be as powerless in military conflicts.

Fundasaun Mahein greets these trends and hopes they will spread to the ASEAN region and the Community of Portuguese Language Speaking Countries (CPLP). Asia is badly represented by women in the security forces with cultural norms providing a sometimes-insurmountable barrier for women wanting to join the security forces. Timor-Leste, despite being a developing country in Asia, has however been doing admirably well involving women in the security forces. Latest statistics count 593 women serving in the PNTL, comprising 17.66% of the total. The highest ranked women serving in the PNTL is a superintendent, the third highest rank in the PNTL. These statistics while encouraging still have some distance to go to catch up with other developed nations such as the UK (27.3% of police the force being women) and Australia (34%). Timor-Leste also has large problems of domestic violence in household suggesting that women’s empowerment is not being translated into the household.

Despite this all there is promise for improvement and Fundasaun Mahein would hope that Major General Lund is an inspiration to all women wanting to join the security forces, whether that be in Timor-Leste or the elsewhere in the world.

The Investigation policy of weapon in Timor-Leste

Mahein’s Voice No. 78 analyses issue of the weapon becomes the concerns of the all entities because it has not finalized yet thus far. Those missing weapons in 2006 crisis and afterwards period did not know the whereabouts as well. Even there has been the investigation for the missing weapon however public did not know yet over its process and how is the implementation recommendations of the investigations’ process.

According to report which is recommended by the investigation commission that there should have investigation process to member of PNTL, former of F-FDTL and some civilians referred to pistol and some riffles that they made disappear, where have identified 26 members of PNTL made disappeared pistol and HK-33 of PNTL. A PNTL member referred to pistol of F-FDTL, 3 formers of PNTL member referred to pistol of PNTL, 5 members of F-FDTL referred to pistol of F-FDTL and a civilian referred to a gun HK-33 of PNTL.

Therefore, the armament investigation commission of F-FDTL and PNTL recommend that it needs to have the investigation process to members of PNTL, former of PNTL members and some civilians. And report of the armament investigation commission of F-FDTL and PNTL particularly, weapon of PNTL recommends to make criminal and discipline processes for effective members of PNTL as well as former PNTL members who did not have responsibility for weapons which are belongs to theirs. And they have shown irresponsibility during the investigation process. This report recommends that officers, sergeants and agent of PNTL who have mentioned on the recommendation of the investigation report forbade them not to use guns in duty hour.

As well as the investigation result of the accusation process of PNTL weapon with Indonesia entrepreneur PT. PINDAD (Persero) by the eventual commission based on the mandate of the government resolution No. 13/2013, 26 June. The mandate from the eventual commission has published the report on 3rd February 2014 with some recommendations and the commission has further given to the Ministry of Defense and Security including the Republic President, which was raised on the weapon accusation processed in 2012 by the Indonesia entrepreneurs PT.PINDAD (Persero) to PNTL, where Fundasaun Mahein had alerted previously that the purchasing process of the weapon considered has the irregularity and the National Parliament committee B considered that those weapons are illegal because it has not been based on the legal procedure.

Recommendation report of the eventual commission also recommends to make discipline and criminal processes for the main actors within the institution of PNTL and the Secretary State of Security regarding the involvement on the accusation process and admit the weapon which is not be based on the legal process and it refers to the General Command of PNTL as well as the Secretary State of Security.

Fundasaun Mahein urges the Ministry of Defense and Security to be serious to conduct the implementation of the investigation report whether related with the criminal’s or other practical which would not promote for well-governance. So we could professionalize the institution of security and promoting the principality of well-governance inside the institution of security such as PNTL.

Recommendations

1. Recommends to the Ministry of Defense and Security to implement the recommendation of the investigation report of F-FDTL and PNTL weapons which have been published in 2011. Particularly to make the criminal and discipline process for effective members of PNTL and former members of PNTL who have no responsibility for those weapons that are really belongs to theirs.

2. Recommends to the Ministry of Defense and Security to implement recommendations of the investigation result of the eventual commission of 2014 that insisted to make the discipline and criminal processes including other violation which would not promote to well-governance.

3. Recommends to the Ministry of Defense and Security to be serious to conduct those processes in order to professionalize the Security Institution and the principalities of well-governance.

4. Recommends to the committee B National Parliament to fiscalize and urge the Ministry of Defense and Security over how works of the implementation of both investigation reports and how was searching of those missing weapon.

Petty Corruption in the PNTL

Quite recently in the national media a case of corruption within the PNTL was reported. In this case several members of the PNTL were caught selling fuel originally designated for police use only. This case highlights a worrying trend that Fundasaun Mahein is very concerned about, that of petty corruption within the PNTL.

Fundasaun Mahein has also been receiving increased complaints from motorists of being forced to pay bribes to traffic police, with the majority of these complaints coming from the ex-pat community. A case reported to FM quite recently, which reflects the majority of complaints, has the respondent being pulled over by police for driving the wrong way but then being forced to pay far above the standard rate for a fine to receive their car documents back and then being refused a receipt as it was a “friend to friend” payment. In this case the PNTL used the ignorance of the driver, in the proper procedures for issuing fines, to extort money for their own gain. The other troubling fact of this case was that this happened at the Balide police station, where it seemed all the PNTL present at the station at the time, including the commandant, were in on the deception.

Fundasaun Mahein is concerned that corruption is becoming more widespread and accepted amongst all ranks of the PNTL and is concerned this may spread to other public institutions.

These are very serious issues as Fundasaun Mahein believes that corruption is one of the single most destructive things in society. Firstly corruption has the potential to undermine faith in an institution and society, reducing public trust in a government that is meant to protect them. Secondly it reduces the already scarce resources of the state meant for the improvement of Timor-Leste’s people and society, instead going on to benefit only a few well connected people. Lastly it tarnishes the reputation of the country to foreigners, meaning less tourists will visit and will also decrease the amount of foreign direct investment and development money that comes into Timor-Leste.

Fundasaun Mahein would like to see the office of the ombudsman follow up and more vigorously pursue any corruption claims, no matter how small, before corruption spreads and becomes systemic amongst all public institutions in Timor-Leste. FM would also ask that all public to not to engage in paying any bribes or engage in corruption so as not give fuel to the fire. FM would also like to remind the public that paying bribes is strictly illegal in Timor-Leste as it is everywhere else in the world. Correct procedure for paying any car fines

• If a police officer pulls you over for an offence they have the right to either take your car keys or registration documents until payment of a fine

• The police officer must give you a notification form stating what you were pulled over for and the fine applicable.

• You must then take the form to the Dept. of Transport or in Balide and pay there.

• From there they will give you a stamped receipt of which you can then take back to the police officer who will then return your car or documents

• A fine should only ever be in the price range of $10-$15

Prime Minister Xanana Gusmao recently announced that the government would end its practice of granting preferential treatment to veterans when it comes to approving construction project tenders in Timor-Leste. The announcement comes in response to Timor-Leste’s untenable contract-bidding system, which for years has put favoritism ahead of legally mandated standards and Aprovizonamento Dezemvolvemento Nasional (ADN) regulations.

The declaration was met with a wave of backlash from veterans criticizing Prime Minister Xanana Gusmao of hypocrisy and political posturing. They claim that the prime minister has no right to blame veterans for carrying out projects that he endorsed them to carry out. Instead of using each other as scapegoats, however, both the government and the veteran’s association should own up to the role they each have played in corrupting the legitimacy of Timor-Leste’s construction industry.

Parties on both sides of the issue share a measure of the blame. Although veterans must pass a screening conducted by the ADN just like any other bidder, veterans who are unable to meet the minimum requirements for ADN approval are often still able to bypass the screening process by acquiring a letter of endorsement from the Prime Minister’s Office. As a result of this favoritism, a rash of unqualified veterans are given approval each year to conduct construction projects throughout Timor-Leste.

The repercussions of these mismanaged projects are clear. The development of infrastructure and the quality of projects carried out in Timor-Leste is notoriously poor, and is clear that the Timorese public bears the brunt of this burden. The traffic caused by overdue road construction in the streets of Dili is just one glaring example of this. FM estimates that as many as 80% of construction projects in Timor-Leste are of low quality, a figure which includes a large proportion of projects carried out by veterans.

Furthermore, the involvement of veteran groups in construction projects has been destabilizing to not only the construction sector but to national unity as well. There have been numerous cases reported of veterans arguing amongst themselves in hopes of securing construction contracts, even after the contract in question has been assigned. This often takes the form of intimidation, arguments and the actual obstruction of projects. Aside from hampering infrastructural development, these disputes also lead to the intimidation of professional, qualified firms who should be competitive bidders for infrastructure projects in Timor-Leste. As a consequence, community residents see little progress while veterans fight amongst themselves in hopes of increasing their profit from projects that should be designed first and foremost to benefit the residents themselves.

Both the government and the veterans association must take steps to respond to this issue. The government has urged veterans to organize themselves into an association, but has done nothing to support the veterans association since its formation. In moving forward, the government must do more to enable veterans to lead successful projects.

For their part, veterans must accept that the preferential treatment they have enjoyed is now a thing of the past. Their projects will now be held to the same standards as those led by non-veterans, and they must do far more to ensure that they are capable of meeting those standards. In addition, the veteran’s association must take steps to end disputes over contract rights and claims to territorial ownership between veterans. These territorial disputes are a threat to national stability and security, and veterans must pledge to end them if they wish to receive support from the government moving forward.

FM recommends that the government organize capacity building and training for veterans so that projects led by veterans will meet professional standards. Providing project oversight training to veterans will enable them to lead projects knowledgeably, and will prevent them from being exploited by construction engineers and contractors. In this way, veterans will be able to utilize construction engineers as employees instead of partners.

The government must also uphold its commitment to ending the practice of approving projects led by unqualified veterans. It is essential that veterans meet or exceed the ADN’s criteria for approval, and that they are not given the preferential treatment they have enjoyed in the past. Correspondingly, the prime minister’s office must discontinue granting letters of endorsement to veterans.

Finally, the government should refrain from making generalizations about veterans in the future. If a veteran is to blame for a faulty project in the future, the punishment and criticism should fall on the individual, not on veterans as a group.

As mentioned in the view of NSDP that Timor-Leste by 2030 will have a modern diverse economy and will move away from subsistence agriculture by re-investing in commercial products from natural resource production.

The government has had a meeting with the council minister to approve a cement factory which will be located in Caisido area, Trilolo village of Baucau district. The investor will be coming from Perth, Australia, his companies: BGC and Swan Energy. According to their plan this project will be implemented on January 2015 with the purpose of this industry is to diversify the economy of Timor-Leste based on the views of the National Development Strategic Plan 2011-2030.

According to Fundasaun Mahein this cement factory is in line with national development and will help resolve some unemployment issues. On the other side of the issue though, that needs attention from the government, is to find an adequate solution to any conflict that may arise from the tension that the building of the cement factory has created.

In the beginning of the consultation process, the government and company did not explain in full detail the state’s policy over land, the environment and the impact of the cement factory to the affected communities. The government explanation was that the factory is to not only to produce cement for a long period but will provide job creation as well and will allow thousands of people to be employed at the periphery. This explanation has created confusion over jobs, as it is not clear who is eligible for these positions? Whether it be the communities or technicians of the Company?

Fundasaun Mahein’s observations have identified that there is a strong possibility for land disputes in Caisido area. This could arise if landowners disagree with the construction of the cement factory, these have the potential to arise because of cultural issues and poorly defined land ownership rights.

Recommendations

1. FM recommends to the Ministry of Petroleum and Oil Resource with its Inter-Ministerial Team to conduct clear socialization efforts with the communities before building the cement factory in Caisido area.

2. FM recommends to Districts Conjoint Team and the Company to explain clearly to the communities over the environmental impact of the cement factory so the communities will have better information about the risks they face.

3. FM recommends to the government and the company to have a legal contract deal with the communities in order to ensure the communities’ life in the future.

Discipline in the security System

As the nation of Timor-Leste becomes mature and its institutions more complex it is imperative that discipline and adherence to all relevant laws and regulations is maintained throughout all sectors of the government. This is especially so in the case of the security forces. As Fundasaun Mahein has noted in the previous blog, we are concerned that petty corruption is becoming more and more entrenched in the security forces. As a follow up to this we believe that a more robust system of investigating abuses committed by the PNTL and F-FDTL should be put in place as well as increasing the penalties imposed for any breaches in protocol, especially if it is a breach in the laws governing the country.

As part of the Fundasaun Mahein’s ongoing obligation in monitoring Timor-Leste’s security sector we have compiled a list of disciplinary actions by the PNTL and F-FDTL. From the 2006 crisis there were 12 members of the PNTL that were suspended from duty for the following allegations: Missing weapons, Abandonment of duties, mistreatment of civilians and the abuse of power. These claims are still being investigated by the Secretary of State of Security’s office. From the F-FDTL Fundasaun Mahein has recorded 20 soldiers being suspended from active duty for the following offences: abandonment of duty, polygamy, corruption and general ill-discipline.

Fundasaun Mahein would, first of all, like to applaud all measures employed by the state designed to bring these cases to light and to discipline all those involved. Fundasaun Mahein however would like to see this go further. Fundasaun Mahein would first of all like a far more robust investigation procedure into ALL cases were a breach of conduct or regulations has occurred. In cases were an actual breach of law, that the security forces have sworn to protect, has occurred Fundasaun Mahein would like to see any parties responsible face prosecution in a court of law.

These measures would have a three-fold effect. Firstly that any members of the security forces that have broken the law face justice, providing solace to any victims. Secondly it will serve as an example to all ranks that misconduct is not acceptable and that there will be consequences for any dishonest actions and will hopefully reduce any spread in corruption among the security forces. Thirdly it will reward the many members of the PNTL or the F-FDTL that do their job competently, professionally and honestly.

Fundasaun Mahein hopes that by implementing these measures and having a more rigorous disciplinary process all of Timor-Leste can benefit from having a more balanced, fair and professional army and police.

Friendship Operation: Re-integration or Threat?

At the beginning of 2014 the government of Timor-Leste issued a resolution of the National Parliament No. 05/03/2014 called “Operation 66” that authorized the National Police of Timor-Leste (PNTL) to act against the group Maubere Revolution Council (KRM) and the Popular Council Defense of the Republic Democratic of Timor-Leste (CPD-RDTL). This resolution of the Council Minister No. 08/2014, that authorized the FALINTIL-Defense Force of Timor-Leste (F-FDTL) to support PNTL in the “Friendship Operation”.

Through the resolution of the Council Minister, the government established the Conjoint Operation Command (COC) as a continuation of the “Operation 66”. During the operation there was conflict between the KRM, CPD-RDTL and PNTL, the result of which was the traumatisation of communities and the escape of some members of KRM and CPD-RDTL Mt. Matebian. Therefore, the government established a “Friendship operation” with the purpose of restoring security for the communities after “Operation 66”.

According to FM’s monitoring we have identified that during the “Friendship Operation”, three COC established 1 post in sub-district of Laga, Lalulai village, 2 posts in Baguia sub-district, Osso-Huna village and Samalari, and 1 post in Quelicai sub-district, Lakuliu village where the Central Post Operation Tactics, in charge of making strategy plans and co-ordinating logistic assistance and administration, was located.

This report concludes that these two resolutions issued by the National Parliament and the Council Minister and the resulting “operation 66” and “Friendship Operation” were not successful and has appeared to make the security situation worse than before. The communities have felt more under pressure with the COC’s presence as well as some rifles have not been re-collected yet and are missing. This information however is only rumors and no credible data from the intelligence side. Ironically it is the innocent people that have become victims of the operation and such operation is out of the resolutions order.

Re-integrated members of KRM and CPD-RDTL are unable to re-integrate with the communities who are suspicious of KRM and CPD-RDTL threat to society. Therefore to re-integrate the community should not be using the army or police but through dialogue and peaceful means instead. This needs an integrated approach by the government for the complicated problems whether social, economic or problems from veterans.

Finally, the contents of the resolution is considered a threat to national stability and the state’s sovereignty and the operation itself considered a political trick which in the past has been an issue with the leaders of this nation. Therefore, FM considers that the resolution is political stunt and the establishment COC through the “Friendship Operation” is like a political threat and not the political threat.

Recommendation

1. Recommend to the President of the Republic, as a symbol of the National Unity, to organize a dialogue with communities, particularly victims and people who have been involved in KRM and CPD-RDTL groups. Coordinate with the government to re-integrate the communities in a peaceful and integrated manner.

2. Recommends to the National Parliament calls the Ministry of Defense and Security to clarify to the public what the result of the COC’s operation process against groups of KRM and CPD-RDTL.

3. Recommends to the government to pay attention to veteran’s case and resolve some existing problems regarding the state’s recognizing the participation of people during the struggle period fairly.

Allegations of Corruption and Abuse of power within the Security Sector

Fundasaun Mahein has published three reports over the execution of 2013 State General Budget for the Ministry of Defense and Security (MDS) including an Investigation of the purchasing process of weapon by PT. PINDAD (Persero) Indonesia and the lack of quality uniforms for the National Police of Timor-Leste (PNTL). Therefore FM recommends investigating for these processes because of the irregularities that have occurred on the State General Budget, purchasing process of weapon to PNTL as well as no quality of uniforms.

Therefore, this report asks the Commission of Anti Corruption (CAC) and the Public Ministry to hold an in-depth investigation for the execution of the state general budget and for the Ministry of Defense and Security, where 209 projects used the single sources even when those projects were not considered as urgent. Allocation of the 2013 state general budget for the Ministry of Defense and Security was totaling $68.199.000, where the budget of MDS used in the single source contracts having a value of $18.837.890.500 signifying that 44.7% of the total state general budget is based on irregular procurement processes.

FM identified and based on the law No.9/2011 on 17 August, article 3 No.1 part c), stated clearly that every contract of a value up to $500,000 should get a visa (vistu previa) from the Camara Beads of the Administrative Superior Court, fiscal and beads (Kamara Kontas Tribunal Superior Administrativu). However, the reality shows that some contracts that are more than this amount, MDS however divides the purchase into two contracts but from only one supplier. Ironically some contracts date of completion for projects have been done before the start date of projects.

The COC needs to hold an investigation for the purchasing process of weapons from PT.PINDAD (Persero) Indonesia to PNTL that is considered to have occurred irregularity in this process particularly the purchase of the weapon PM2-V1 to PNTL by PT.PINDAD (Persero). The procurement process of this contract; signed by the government of Timor-Leste through the secretary state of security (SSS) with the director of the company PT.PINDAD (Persero), “Supply Security Equipment (Weapon) for PNTL” with the contract number 12000513 for 24 days, started from February 23rd to April 6th 2012; with the type PM2-V1, 75 unit and number of funds that have been cited on the 2012 state general budget was U$112.500.000.

Regarding the report of the eventual commission detected that there was bad coordination within the institution, indication of power abuse, falsifying documents and no involvement of the National Directorate Procurement of SSS during the negotiation process between PT.PINDAD (Persero) and PNTL. The report of the eventual commission has recommended that it needs a criminal and disciplinary processes to SSS and PNTL General Command responsibilities.

Another case is about uniforms of PNTL that were distributed to members of PNTL at its general quarter and 13 districts command of which had no quality because of an insufficient budget. The Kalbes Unipessoal Lda Company distributed such uniforms with the total 2551 to logistic department based on the contract. A set of this uniforms composed of hat, shirt, rank, emblem, trousers, belt, shoes and socks with the total funds around U$120.000, yet it was sufficient only for thin uniforms. Uniforms for (PNTL) women are 478 and for men are 2551 units with the total budget around US$58.000.000 of the 2012 State General Budget.

This company had already failed in the first phase, regarding the thin uniforms, and were sent back to Indonesia. However on the second phase this company (Kalbes Unipesoal Lda) was approved by the PNTL general inspection and agreed this company to distribute those uniforms to 13 districts command, in fact that the uniforms still had no quality. Regarding bad qualities of the uniforms, the secretary state of security and the PNTL general command blamed each other over the responsibility regarding the process contract with the Kalbes Unipesoal Company on purchase the uniforms case. From the above mentioned cases FM questions strongly of these processes; why the secretary state of security and PNTL general command blame each other over responsibilities of purchasing uniform process? It means that there is no good communication between both sides.

Recommendation

1. Recommends to the State General Inspector, Commission of Anti Corruption (CAC) and Public Ministry to hold an investigation into the National Procurement of the Ministry of Defense and Security regarding the single source projects.

2. Recommends to CAC and Public Ministry to investigate the Secretary State of Security, PNTL General Command and some other member of PNTL who are involved in the purchasing process weapon by PT. PINDAD (Persero) Indonesia.

3. Recommends to CAC and Public Ministry to hold an investigation into the Secretary State of Security, PNTL General Command and Kalbes Unipesoal Lda Company over the purchasing uniforms process to PNTL that have no quality and the confusion over whose responsibility procurement of these uniforms was

Last Friday (27/06) marked a great leap backwards for the security of Timor-Leste. Not one but two incidents show the growing dysfunction of the security forces towards each other and to the people of this land.

The first incident seems to be an indictment on the attitude that now seems to pervade the PNTL.

Around the afternoon of the 27 June 2014 a deranged man wielding a chain entered Timor Plaza and proceeded to run amok. He damaged at least some stores, threatened numerous people and created a general panic in the mall. Police after detaining the suspect for a brief period allowed him to go free. Their explanation for letting him go; he had mental problems, was on drugs and was also the son of a PNTL commander. They left soon after but not before suggesting that Timor Plaza tighten up their security.

This indecent suggests that PNTL have become either unwilling or too lazy to do their job when presented with an “open and shut case”. There were numerous complainants, witnesses and victims in this case that could have testified very easily against the suspect. Also as the police themselves noted the suspect was on under the influence of drugs, at last check, a crime in Timor-Leste. The last excuse given by police, that the suspect was the son of a commander, has confirmed what many of us have long suspected; that justice depends on who you know or who you are related to.

The second, more serious incident, of the day came from a breakdown of discipline in the PNTL Battalion Order Public (BOP) station in Ai-Mutin. In this incident junior officers attacked senior officers in a very serious breakdown of military discipline and hierarchy in this battalion.

Fundasaun Mahein, through its ongoing monitoring of the security sector, is aware that a lot of smaller incidents of excessive force against civilians goes unreported in the districts. We believe that this latest breakdown in the discipline of the PNTL-BOP comes as a direct cause from this culture of violence to resolve issues that has been allowed to pervade the security forces.

We are also very concerned as the last great breakdown of discipline in the security sector was one of the main causes of the 2006 crisis.

All together the main consequence of these two incidents is the breakdown of trust between the public and the security sector organisations. If a citizen does not trust the security organisations to be able or willing to provide that security to them how can they trust the government that oversees these organisations either.

Fundasaun Mahein believes that these two incidents need to be addressed as quickly as they can to stop any further erosion of confidence in the security sector as well as to stop any further lapses in discipline in the armed forces.

Fundasaun Mahein recommends the following;

1) For the PNTL and PNTL-BOP to immediately conduct inquiries into the incidents that occured on the 27/06

2) For PNTL-BOP to punish all junior officers responsible for attacking senior officers.

3) For the officers responsible for letting the suspect that attacked Timor Plaza to be held accountable for their actions

Fundasaun Mahein has recently been getting reports of counterfeit money circulating in Dili. Luckily so far most of the fake money that has been coming out so far has been of a sub-standard quality and so should be easily spotted. Fundasaun Mahein however would like to remind its readers to remain vigilant against these fake bills as they are NOT legal tender and will not be accepted at any bank.

Fundasaun Mahein has managed to find a sample for greater analysis. See below:

The Bill on the left hand side is the counterfeit bill while the bill on the right is the real thing. Notice the worn appearance of the fake bill, this is due to the inferior quality of the paper which has a more spongy texture. Also note that the fake bill is slightly smaller than real bill on the right. The small yellow “20” marks however look like they are still intact along with a bad quality watermark indicating the counterfeiter was using advanced equipment.

So far we are unaware of where this counterfeit money is originating from however from its appearance we suspect it is coming from either an organised crime group in Dili or an individual with high quality printing equipment.

Fundasaun Mahein asks the public to be aware of these counterfeit bills and hopefully together we can get these notes out of circulation.

After 24 years of Support from the CPLP, Now Dili Holds the Conference for CPLP

The “Comunidade dos Países de Língua Portuguesa” will finally roll into Dili this coming Thursday (17/07) for a week long conference between countries with a shared Portuguese language. No doubt, the elite that attend this conference will at some point have to drive past the many renovated parks, public areas and repaired roads that have been fixed in anticipation for this conference.

But at what cost has this come for the common person in Dili?

Any person living in Dili has no doubt seen the debris, rubble and dust, that has made the city seem more like a construction site than the Capital City for the past few months leading up to this event. This has caused much frustration and anger from many people unable to access areas they could in the past or from motorists stuck in traffic jams worse than ever before. Many businesses as well have been affected from the construction, due to reduced traffic from road blocks and detours as well as the constant power cuts that are reducing their ability to do business. We ourselves at Fundasaun Mahein, along with everyone else in Balide, have had to endure daily power cuts that go for four hours on average, leaving us unable to continue our work during this time.

Fundasaun Mahein also questions the validity of some of the measures done to prepare Dili for the CPLP conference. Some of these measures, such as creating a park in the middle of a busy roundabout, seem to have very little practical use and don’t justify the months of traffic jams necessary to build them. Other measures, such as moving markets from their established spots, have had a very real effect on peoples economic livelihoods, done so the elite ministers don’t get bothered at the sight of people trying to make a living.

These preparations for the CPLP have clearly had an impact on the economic security of the many people living in Dili while we here at Fundasaun Mahein are becoming more alarmed that the ongoing haphazard construction is affecting human security as well. We see this everyday with the dust that can cause respiratory health issues, with the rocks strewn on the road that have the potential to fly up and hit unsuspecting pedestrians, and with the careless work done by construction crews. Just last Sunday (13/07) a report came to FM of a one year old baby being hit and killed by a construction vehicle just behind the Ministry of Foreign Affairs.

Fundasaun Mahein also questions the wisdom of bringing in a large amount police officers in from the districts to provide security for the CPLP, leaving many districts understaffed with security personnel. Do the ordinary people in the districts not deserve as much security as the Elite ministers attending the CPLP?

Fundasaun Mahein fully understands that in order for Timor-Leste to become a vibrant prosperous nation these development projects need to happen, however we believe that it is for the ordinary people these developments need to happen instead of being done to impress some elite foreign ministers who have only come for a week long conference.

We hope that after the Conference the government will be able to continue its effort in developing Dili, for the people of Dili, in a safe planned manner done with a minimum of inconvenience for its people.

The Politics of Purchasing Weapons from Indonesia: A Threat to Security Strategy

Timor-Leste and Indonesia recently are really enjoying a romantic cooperation in some important sectors. This cooperation has occurred on economic, social, security-related, and even political fronts, as the two countries vie for Timor-Leste’s induction to the Association of South East Asian Nations (ASEAN). This occurs in spite of the historical rivalry between FALINTIL and TNI (Tentara Nasional Indonesia), who were enemies during the Indonesian occupation. It is the first time Timor-Leste appears, 15 years after the people of Timor-Leste separated from Indonesia. It can be said that, though these enemies aimed to kill each other in the past, now these powers are looking to support, lend funds, and sell military equipment to each other. This cooperation can strengthen the relationship between these neighboring countries and serves as an importance means of enhancing good relations, peace, and stability in region.

But one must consider another angle as well, from the perspective of policy and strategy, if these countries are to depend on each other for military equipment. Enemies can be friends, yet this depends on each county’s interest. Timor-Leste and the Republic Indonesia are developing and dealing with the defense cooperation area, and the main provision of this contract is that Timor-Leste intends to purchase military equipment from PT.PINDAD (Persero) and other entrepreneurs from Indonesia that produce the military’s equipment.

Prior to this, Timor-Leste has purchased weapons on a large scale from the PT.PINDAD (Persero). 75 ‘PM2-V1′ weapons were issued to the National Police of Timor-Leste (PNTL) in 2012. According to the Indonesian media, Timor-Leste will purchase more military equipment. Therefore, Timor-Leste will communicate intensively with Indonesia through the contract that has been signed by leaders of the two countries.

However, Timor-Leste needs to know that Indonesia does not ensure yet management and controlling of the weapons themselves. Some weapons have been used by some terrorists in Asia, entrepreneurs, civilians, and other army groups in Papua. These weapons have also been used in some conflict areas in Indonesia, such as Poso and Maluku. Those weapons are produced by the PT.PINDAD (Persero), and the weapons are being sold by individuals of the National Indonesia Military (TNI) and the Indonesia Republic Polices (POLRI), including weapons stolen from the TNI and POLRI armories.

On another note, Timor-Leste and Indonesia have close boundaries and seas, and this poses a potential threat. If any situation occurs along the border line, Timor-Leste and Indonesia will blame each other if criminals or terrorists use these weapons. Timor-Leste is facing problems in management and control of weapons, according to word spreading among communities in Timor-Leste that illegal weapons exist here. Furthermore, Timor-Leste purchased weapons in 2013 without detail process, and this represents a problem of its own.

Recommendations

1. FM recommends that the Ministry of Defense and Security perform a review of the policy used in distributing arms and security equipment to the Institution of Security and Defense of Timor-Leste.

2. Recommends and further adds to the recommendations of the Eventual Commission Investigation that the government needs to consider the circumstances of international policy and progress in this global era and demands that the government classify information regarding the developing the Defense and Security areas as confidential and hidden from neighboring and non-state actors.

3. Recommends that the Indonesian government and the elected Republic President, who will assume power for the next five years, review and fortify the control system for weapons at the armories of TNI and POLRI as well as those entrepreneurs that produce the weapons. This is recommended because people from these two countries are concerned, as neighbors, about the possibility of weapons being used by terrorists, civilian and other army groups as a result of this purchase of weapons.

Xanana Slows Resignation Plans to Ensure a Stable and Peaceful Transition

In November 2013, Xanana announced his intent to resign from office in 2015. Once again, Xanana came forward earlier this year to reiterate his intent to resign, this time suggesting that this resignation would occur as soon as 2014.

At a CNRT conference on 2th – 3th August 2014, representatives from the thirteen districts discussed the impact of Xanana’s anticipated resignation upon future stability, peace, and security in Timor-Leste. As discussed, Xanana has been a strong political presence in Timor-Leste in times both peaceful and turbulent. Many see the current Prime Minister as an essential fabric holding together social groups and political processes in the country. As a result, the delegates concluded that Xanana should facilitate a smooth transfer of power to his successor as well as restructure the Cabinet before leaving office.

It is important to note that though Xanana has announced his intent to resign from the position of Prime Minister, he plans to remain involved in the country’s politics. This includes the creation of a ‘council of elders,’ consisting of Xanana Gusmao, Mari Alkatiri, Lu-Olo, and Jose Ramos Horta. Together, these key Timorese leaders, whose ties date back to the revolutionary period, will help facilitate the upcoming transition of power as well as supervise the new leadership once it is in place. This process will contribute to the stability and efficacy of the new Prime Minister.

Xanana’s announcement has triggered much speculation and concern in Timor-Leste, as citizens consider potential successors for Prime Minister. Potential candidates exist, but many Timorese believe that none are capable of running the country. As a result, there is a growing sentiment that President Taur Matan Ruak, if given expanded constitutional powers, could successfully lead of Timor-Leste.

Advocates of this view explain that, as a middle-aged politician, President Taur Matan Ruak could provide a valuable bridge between the old and young demographics of Timor-Leste. However, this hybrid leadership would entail a significant increase in presidential powers and a decrease in powers of the Prime Minister. Such a profound political restructuring should be subject to popular vote or referendum.

We here at Fundasaun Mahein, engaged as we are in the seemingly thankless task of public advocacy, are always pleased when we find out we have influenced events in any way, shape or form. Although this may not happen with frequency that we would like, any small bit of positive feedback always makes our jobs seem more worthwhile and reminds us why we do the work that we do. With this in mind we would like to share with you a small story.

Quite recently the Fundasaun Mahein research team travelled to Laga sub-district in Baucau district to research the impact of “Operation 66” and the follow up “Friendship Operation” that the National Parliament authorised in order act against the Maubere Revolution Council (KRM) and the Popular Council Defense of the Republic Democratic of Timor-Leste (CPD-RDTL). While there our research team conducted research into the operations and interviewed victims and affected members of the communities. As a result of these investigations FM released its report Mahein Nia Lian 80 that highlighted the fact that operation had in fact made security in the area worse than before and didn’t achieve its goals as members of the two groups managed to escape. The report also made note that the main victims came from the community, the very people that the F-FDTL and the PNTL were there to protect.

As a result of this report being submitted FM is very happy to say that there has been a reaction from the government. Firstly the Minister of Defence and Security (MDS) has ordered the military to immediately start providing aid and medication to any of the victims of either of the operations. Secondly the Secretary of State (SES) for security has lodged a formal complaint and demanded an investigation into the operations.

We are happy first of all that the government continues to listen to Civil Society organisations and react to our critiques. We are also happy that the response from the Minister of Defence and Security and the State Secretary for Security SES was so forceful, showing their commitment to creating a more peaceful society.

What we here at FM though are most pleased about however come from a letter we have received from some members of the affected communities. In it they give their thanks to Fundasaun Mahein and express the positive impact on their lives ever since our report was published. Again they can look forward to living in a more peaceful, stable society.

Dismissal member of F-FDTL-PNTL: As a Part of Discipline Reformation?

In Mahein’s Voice No. 83, Fundasaun Mahein conducts a discussion concerning the policy of dismissal inside the institution of Falintil- Defense Force Timor-Leste (F-FDTL) and the National Police of Timor-Leste (PNTL). This policy aims to transform and professionalize the military and police institutions addressing the attitudes of some military and police members that have violated the laws and disciplinary rules of the institution.

Since the establishment of the F-FDTL and PNTL institutions, the government has made many of efforts to develop these two important institutions. These efforts include fortification of human resource, improvement of infrastructure, modernization of equipment, and the production of laws and disciplinary rules for the military and police. However, disciplinary issues of F-FDTL and PNTL members present a challenge to the establishment of professional military and police institutions.

As part of the government’s initiative to professionalize the F-FDTL and PNTL, the Superior Commanders of F-FDTL and PNTL have made the decision to dismiss many times. This dismissal has been issued to undisciplined members who have violated the organic laws and disciplinary rules of the military and police. In some cases, these individuals have abandoned their duties and even committed crimes.

An example of such a dismissal case occurred in the beginning of 2014, when the F-FDTL superior commander dismissed 19 soldiers on disciplinary grounds. Another case involved the PNTL commander dismissing a PNTL member, who had committed crimes during the 2006 crisis and hidden the weapon in question. The dismissal issued by the F-FDTL and PNTL superiors have made a positive impact upon disciplinary reformation in these two institutions.

However, Fundasaun Mahein expresses concern regarding the intent of these dismissals. One must ask whether these dismissals represent serious efforts by F-FDTL and PNTL superiors to reform military and police discipline, or whether they simply serve to execute disciplinary penalties for members? Fundasaun Mahein continues to urge the government to fortify human resources, improve administration, and improve management of certain services, such as the minimum work and equipment conditions necessary to motivate members of F-FDTL and PNTL to effectively serve the nation and people.

FM’s Recommendations:

1. FM recommends that the F-FDTL and PNTL institutions to continue fortifying the institutions based on the laws and rules of the institution. Leadership should continue applying penalties to members of F-FDTL and PNTL who do not obey the law and regulations of the institution, as well as continue improving human resource inside the institution in order to further professionalize the military and police institutions.

2. FM recommends that communities, as part of their public responsibility, share information with the commanders of the F-FDTL and PNTL regarding any instances of disciplinary violations or criminal actions by F-FDTL or PNTL members against the communities.

FALINTIL Celebrates 39th Anniversary: FALINTIL is the Fish and People are Water

In independence era, the FALINTIL force underwent the process of self-transformation to become the professional force known as the FALINTIL- Defense Force of Timor-Leste (F-FDTL). Automatically, the nation expected that the F-FDTL would become a professional force, embodied by intelligence, discipline, dignity, and loyalty to the people. This force would perform its duties with responsibility, ensuring external security and serving the people in a dignified manner. While the F-FDTL assumed a military capacity, it would also be regarded as “Civilian Force” whose work is tied closely to communities.

During its days in the forest, the FALINTIL acted according to the slogan “Falintil is the fish and People are Water”. This slogan tied FALINTIL and the communities together, to work and live for the communal purpose of “Liberta Patria”. With this approach, FALINTIL and the communities fought together and finally achieved independence, so this serve as a model for the young force of the F-FDTL, who should continue to embody this spirit.

The struggles of the F-FDTL in city are not the same struggles undergone by those FALINTIL forces in the forests. F-FDTL of today often work in an office setting and, thus, should obey the law and various rules, with an emphasis on professionalism, discipline, and respect for human rights.

As it celebrates its 39th anniversary, FALINTIL can be called an old institution, when compared its other state counterparts, but its work and its legacy have been passed down to the F-FDTL. Therefore, FM encourages every individual of the F-FDTL to maintain the discipline and professionalism shown by FALINTIL, who died for the liberty of this nation. These heroes’ experiences live on an example for liberating people in this independence era.
