Who Should Take Responsibility for Members of the PNTL Committing Crime?

Mahein’s Voice No. 84 investigates the process of managing cases involving PNTL misconduct. These cases involve PNTL members who have committed crime and violated the organic law of the PNTL institution.

The National Police of Timor-Leste (PNTL) is the organization responsible for reducing crime within communities. The service of the PNTL is based upon institutional rules and regulations, in order to maintain discipline and prestige in the organization.

Rules and principality have been set up by the PNTL, and these statutes guide the juridical process of addressing matters of discipline and crime within the PNTL. However, the public is concerned at present, due to cases involving PNTL professionalism, impartiality, and inappropriate use of force and security equipment.
Furthermore, an assaulting case between members of PNTL from the two units serves as an example of the need for law and order. This incident has ultimately damaged the reputation and professionalism of the PNTL in the eyes of the communities.

The cases mentioned above are responsibility of the PNTL justice department, who should respond accordingly and perform a thorough investigation of cases involving of PNTL crime and non-compliance. During the period of 2009 to 2014, the justice department has registered lots of cases involving discipline infraction and the consequences have been determined by the commander of the PNTL, who has already dismissed 28 members.

In addressing this problem, the justice department will face challenges in human resources to process the case as soon as possible, as some cases to this day have not yet been totally processed.

Fundasaun Mahein views such cases merit the attention of the institution of the PNTL, because the current process of processing and investigating cases simply takes too long. Therefore, FM urges the government to continue fortifying human resources at the department of justice with facility assistance, in order to improve and ensure compliance of PNTL members to the organic laws of their institution.

FM’s Recommendations

1. FM recommends that the government fortify human resources within the PNTL institution, particularly in the Justice Department and the Criminal Investigation Service (CIS). This fortification will accelerate criminal cases involving members of PNTL, which will in turn minimize misdeeds by police members and improve the prestige of the PNTL as institution.

2. FM recommends that the PDHJ, National Parliament, Committee B, and Civil Society work together on human rights issues. These institutions should continue monitoring police activity and rigorously advocate the acceleration of criminal cases involving police members to the PNTL commander and Public Ministry.

On the 15th anniversary of Timor-Leste’s referendum, the government hosted the Com De Cordasaun Medal awards. In these awards 26 foreign activists were awarded medals for their contribution in Timor-Leste’s struggle for independence. Of these recipients 24 were from Australia and 2 from Indonesia itself.

Fundasaun Mahein, as one of the participants of the ceremony, would like to extend our warmest congratulations the recipients of these awards and our deepest thanks for the sacrifices these people made to ensuring East Timor’s freedom.

The largely thankless task that these recipients, and many others like them, of protesting the Indonesian occupation of Timor-Leste is often overlooked in the historical record and was conducted at great personal cost to themselves. Often combating intimidation, financial duress and apathy these activists spent a great deal of their own time over the 24 years occupation advocating for Timorese freedom. This is even more so for the two Indonesian recipients of this award, fighting their own government for the sake of freedom of Timor-Leste. We here at Fundasaun Mahein can not and will not forget the contributions that these foreigners have made to Timor-Leste’s independence struggle and would like offer our thanks for their actions.

As a symbol, these Foreign Activists brave actions have demonstrated the power of people working together and for also showing us that Timor-Leste does not walk alone. We hope that this continues into the future and that the foreign community continues to work with us to reform the security sector and to ensure that their sacrifices were not made in vain.

Irregularities in the Promotion System of the National Police of Timor-Leste (PNTL) 2012

In 2010, Fundasaun Mahein (FM) published its first report concerning PNTL promotions, in response to the concerns of some PNTL members. Many exhibited frustration with irregularities taking place during the promotion process. The situation at the time was quite bad, particularly inside the PNTL, as many PNTL members expressed their dissatisfaction by disrespecting their superiors and the disciplinary rules of the institution.

The 2012 superior promotion process was a concern for some PNTL members because of the irregularities that took place in the promotion process. Even though promotion protocol has been better established in the past two years, the results have not yet been forgotten and, rather, continue to PNTL members to this day. Some members do not exercice discipline in their services because they are still disatisfied with the promotion process conducted two years ago.

Regarding their frustrations, some members presented a petition to the Prime Minister as well as the Ministry of Defense and Security. The majority of the petitioning individuals are veterans. During the socialization component of the promotion process, it was stated that priority would be given to veterans, and the petitioners do not feels as if this promised was honored. Other members expressed frustration with the promotion results, because management offered no justification as to why these individuals were not promoted, despite their sufficient and high scores during the commission’s evaluation.

One particular case that took place in this promotion cycle and drew the attention of FM was that of Chief Sergeant Sanda do Ceo Maria Costa Bossa. She resigned from the PNTL because the results of the promotion process made her lose motivation in her work. During the promotion process, she was promoted to assistant inspector, but the promotion commission then demoted her to the rank of chief sergeant less than three months later. This incident has caused FM to question the promotion protocol used by the leadership of the PNTL.

Finally, some other members have left their posts but are still receiving salaries in normal fashion, even though they have received a call to attention from their superiors. FM’s monitoring also found that some PNTL members lack discipline and fail to respect the command hierarchy of the PNTL. One underlying reason, they say, is that some of their superiors received low scores on the commission’s evaluation exam but were still promoted. These issues will collectively cause the institution to suffer. Furthermore, if unaddressed, the discipline of PNTL members will continue to damage the institution and lower the motivation of PNTL personnel in their services.

Summary of Recommendations

1. FM recommends that the PNTL General Commander review and evaluate each district commander, unit, and department in regards to police process. This evaluation should include a measurement of police merit, service, dedication, and experience. These departments should also share information with the General Commander regarding challenges that they face in terms of providing services in their districts, units, or internal departments.

2. FM also recommends that the government review the promotion process of PNTL, because the government has recently selected some officers for promotion. This is not realistic or effective, because the government does not work inside the PNTL and, thus, is not well acquainted with its institutional processes. The monitoring process within the PNTL has achieved adequacy in its system of promotion and should continue to work internally. The PNTL should promote its members on the basis of experience and merit, and not with regard to any political or private interest.

3. Lastly, FM urges that this issue of PNTL promotion not be politicized. Instead, home rule should be given to the PNTL to conduct its own promotions, based on criteria that examine candidates’ dedication, experience and merit.

Creation Policy of the Science Police Criminal Investigation (SPCI)
Partner and Threat for the Security Institution

In the beginning of 2014, Timor-Leste has passed a decree law with the scientific character in the criminal investigation’s area. This decree law is about No. 15/2014 on 14 May, of the organic law of the science police criminal investigation. Therefore, SPCI is organized based on the hierarchy at the justice ministry’s shade, and supervise by the Public ministry. In this scope, the SPCI becomes the superior corps of the criminal investigation police that will enjoy the administrative autonomy, financial and heritage.

Why this creation policy of the institution consider as partner or threat? Because of the competencies that attributing to SPCI, in other side completes the services that still complicated thus far. As cited on this decree law that SPCI will only do the investigation for serious crime, organized or the complicated cases. Therefore, on the other side it becomes threat. The creation of SPCI will work double of the services that done by the criminal investigation department thus far such as the National police of Timor-Leste (PNTL), that should be based on the public ministry’s system based on the penal code order of Timor-Leste, so considering that the creation of SPCI is like the policy over position.

In other scope, the SPCI gets especial privilege and treatment, but work for the same issue. Regarding this there will be have another thought that many institutions will work for the same issue, will not motivate and compete among others and will increase the state’s expense, including the investment for the criminal investigation will not concentrate and prejudice to their professionalism. Ironically, those graduates at the SPCI just getting the training within several months then immediately guardianship to the complexity or organized and serious crime cases.

Lastly, the SPCI will utilize weapon as well if the circumstance consider in a risk that is serious and in a big threat for public safety. FM really doubt with this circumstance, because of a long history about utilizing weapon in Timor-Leste that is concerned by the whole society. As an example misused by the security authority, make some innocent people become victims and about the final process have not finished yet at this day. So, the management and the controlling system over the weapon have not got well threaten yet. The national media reports and the community’s concerns that, some weapons of the security authority have used wrongly as well as the individual member that used for hunting.

Recommendations

1. Recommends to the National parliament, Committee A needs to make fiscal for those producing of laws and their implementation.

2. Recommends to the National Parliament and the government needs to create legislation of the criminal investigations, that should define for the mission, attribution and competencies that attributing to each institution, so it will define clearly the action terms based on each naturally and mission.

3. Recommends to the National Parliament and government over the draft laws that have been produced needs to have a clear consultation with the all society entities of Timor-Leste, so it can be reflected to the reality or the nature of Timor-Leste.

Presence of Organised Crime in Timor Confirmed by Recent Drug Arrests

Over the past few days most major news sources have paraded the success of the security sector in Timor-Leste, and particularly the PNTL, in apprehending and arresting three suspects for the importation of illegal narcotics.

To briefly recap the circumstances of the case as currently reported:
• Three individuals have been arrested for the importation of 1.595 kilos of the narcotic, ‘Shabu-Shabu’, into Timor-Leste.
• The substance was uncovered in a parcel from Hong-Kong.
• Of the three suspects apprehended, two are not Timorese citizens.
• The narcotic was bound for drug markets in Indonesia.

Time to celebrate? Certainly from one perspective this story can be seen as a raging success for the security sector and PNTL, which reportedly acted with both authority and decisiveness to ensnare the suspected criminals. However, whilst congratulating the relevant authorities in this case FM can’t help but lament the broader implications of this story in regards to the presence of organised crime in Timor-Leste.

Since 2010, FM has continually warned of the presence of organised crime in Timor, and of the threat of an explosion in organised crime should the inherent vulnerabilities within the country not be addressed head-on. As is evidenced by this case, in which a multi-national criminal group planned a drug operation across a number of countries, FM’s concerns have been validated and organised crime is indeed developing in both scope and sophistication within our nation.

By its very nature organised crime is insidious and opportunistic; it seeks to exploit soft points in the political, economic, security and social structures created within and between nations for economic gain. That reports indicate that the narcotics were ultimately bound for Indonesia illustrates this point, for in the globalised world of transnational crime, Timor has evidently been identified as an ‘ideal’ place for the distribution of drugs to other nations – a rather damning critique of the perceived effectiveness of Timorese government’s social, security and economic policies in combating crime.

What makes this case especially concerning is the profile of the suspects – whilst many have viewed Timor’s many disaffected and unemployed youth as a prime recruiting ground for crime groups, the involvement in this case of middle-class and politically connected criminals significantly raises the stakes – as modus operandi of organised crime is also to network and collude with players in the ruling classes and criminal justice system, in order to legitimise their operations and clear the obstacles that societies and governments rightly establish to protect themselves from criminal activity. This is why the UN Convention against Transnational Organized Crime (of which Timor is bound) stresses the need for nation states to impose and regulate strict anti-corruption regimes. Timor is of course particularly susceptible to such criminal-political collusion as within this nation political elitism, social cliques and broadly established patron-client relationship networks prevail in both the PNTL and the councils of government.

FM is not suggesting that this case establishes that Timor’s organised crime problem is currently out of hand, or that we have a systemically criminally collusive and corrupt government and police force. However, it is naive to think that this case represents either the start or the end of organised crime in Timor, and it is apparent to even the most casual observer that at the present point Timor has all the right ingredients for organised crime to flourish. In this instance the criminals sought to expose weaknesses in Timor’s policing and border protection and customs systems, the next may involve exploiting lax monitoring in the financial sector, or the recruitment of the masses of unemployed and desperate youth for criminal acts, or the lack of effective oversight and anti-corruption measures within the PNTL, or the corruption of relatively lowly paid employees in the political and security sectors, or the lack of education around drugs, violence and human trafficking in our schools.

What is therefore important is how the Government and relevant authorities act from this point forward. Option one is for there to be much backslapping and congratulations of a job well done, and at the same time a feeling within the powers that be of immunity and faith in the status quo. If authorities adopt this option then they will inevitably leave the door open to even greater problems, for if the history of international drug trafficking is to teach us anything – from the infamous Golden Triangle of Asia, to the mountains and foothills of Columbia and the streets of Mexico – it is that a nation that has an initially weak, disinterested, corrupt or even collusive government establishes the foothold for organised crime to develop, and that once this foothold is entrenched, it is almost impossible to eradicate the culture of organised crime from a nation – this despite the passing of generations, substantial resources allocated and sometimes heroic efforts of future governments and security sector actors. We must not let this be the case in Timor-Leste!

Option two is for the authorities treat this case as a warning shot, a wake up call for action and commitment to the policies of crime prevention. Indeed, FM notes some positive developments in the attempts to address this problem:

• On 2 September 2014, The Council of Ministers approved a Draft Law on Combatting Trafficking and Illegal Consumption of Drugs, “…to establish the legal framework for combatting narcotic trafficking, impose the appropriate measures of control and surveillance to drug trafficking, and determine the adoption of multidisciplinary measures aiming treatment and reintegration of drug addicts.”

• In June 2014, Timor-Leste acceded to the United Nation’s Convention Against Illegal Trafficking in Narcotic Drugs and Psychotropic Substances (and is preparing to ratify the two remaining UN conventions on combating drugs).

Nevertheless FM also notes that laws alone cannot solve this problem, and that along with many other problems in this land, there are often wide and tragic gaps between the words of the authorities and their subsequent actions and performance. We therefore recommend that the Government follows-up their words with deeds, and addresses both drug trafficking and organised crime by:

1. Declaring a “War on Drugs” – not through employing empty rhetoric, but by engaging with all relevant Government and non-Government actors including the Ministry of Defense and Security, SEFOFE, Education Ministry, the Secretary of State Youth and Sports, Ministry of Justice, Ministry of Social Solidarity, academics, civil society and community groups to develop an integrated and multi-level drug policing and prevention policy and implementation strategy.

2. Making a genuine attempt to uphold our obligations under UN drug conventions and also the Convention against Transnational Organized Crime. Specific areas to address involve strengthening the regulatory and supervisory regime for banks and non-bank financial institutions to prevent laundering of the proceeds of crime; continuing to promote and priorities anti corruption measures within the political and security sectors; and undertaking bilateral and multilateral agreements and intelligence sharing with our regional neighbors to fight organized crime and trafficking.

3. Requesting that the PNTL Command strengthens its community based policing strategy to increase cooperation with community members and leaders as cultivating better relationships with community sources will garner more accurate intelligence and lead to better detection of organized crime networks and activities, active members, and family members of criminals.

4. Addressing the long-term problem of unemployed and disaffected groups and individuals with programs that promote education, employment and social inclusion

Timor should discuss implications of global terrorism.

The problem with raising terrorism in a public forum is that the issue is often hijacked those wishing to sensationalise or politicise it for their own ends, and it is therefore sometimes difficult to have a reasoned discussion. (Thankfully) Timor is a nation with freedoms of speech, diversity and belief enshrined in its constitution and way of life, and has no recorded organic terror threat. Timor is also a small nation, not a player in the ‘global war on terror’, and has actually distanced itself from this issue. However despite these facts, FM believes that in light of recent events it is wise for Timor to acknowledge the issue of global terrorism and to rationally discuss its possible implications for the nation.

This year the world has heard many stories of atrocities committed by a terrorist organisation known as ISIS (also known as IS, ISIL or Daesh). Recently the Organisation beheaded a number of western civilian hostages and issued a call to arms for “Muslims” to kill American, Canadian, European and Australian soldiers or civilians in any way possible. These developments, along with the commitment of an American led coalition of nations to attack ISIS in its strongholds in Syria and Iraq have led to many nations raising their terror threat alert levels.

Since then, last week in Australia two arrests were made in relation to what has been described as a planned ‘demonstration killing’ (broadcasting the killing of a random civilian). And this week in the same country, a young man was shot and killed after attacking two police officers with a knife. Both these incidents appear directly linked to the ISIS policy of spreading attacks to “non believers” in western nations.

Should these events have any affect on security policy in Timor? FM believes that they should at least lead to discussion of potential vulnerabilities.

One issue could be the migration of terrorists. Similar to organised crime and drug trafficking, terrorists target and exploit weaknesses in social and security structures within and between countries. There is strong evidence that ISIS organisations and sympathisers have established a foothold in some of Timor’s nearest neighbours including Indonesia, Malaysia and Australia. It is therefore logical to assume that as law enforcement in neighbouring countries is strengthened to fight terrorism, Timor’s relatively weak security environment in areas such as land and maritime border enforcement along with its proximity to ‘target’ countries make it increasingly attractive for terrorists wishing to escape scrutiny – in fact a similar scenario to this was reported in 2012. In this way it is not unforeseeable that terrorists could use Timor as a safe ‘jumping point’ for committing terrorist acts in neighbouring nations, perhaps similar to how we have recently experienced organised crime groups exploiting Timor as a means of importing narcotics from Central Asia into the Indonesian market.

A separate possible threat lies in Timor’s close working relationships and agreements with security forces from nations that have recently been directly threatened by terrorist organisations (e.g. US, Australia). Such relationships with foreign forces are essential to develop the capacity of local forces and to build cooperative working relationships to address transnational security issues. However, these ties also increase the risk of a terrorist attacks occurring on Timorese soil, even if the targets are directed at foreign interests and not the Timorese directly. Timor clearly has a responsibility to actively protect foreigners currently working in Timor who may be at an additional risk from global terrorists.

FM is not seeking to exaggerate or overplay the threat of global terrorism by raising these issues, rather, we only seek to promote rational discussion. Ultimately, we ask whether the Government should implement a response to recent events, and if so what should it be?

FM feels that a measured response should include:

1. A commitment to working with our regional neighbours to share anti-terrorism intelligence.

2. A plan to improve boarder crossings and customs screenings in the context of stopping terrorists or those planning terrorist activities from entering the country.

3. An assessment of security arrangements for possible terror targets inside Timor (including foreign groups/organizations).

4. Ensuring effective anti-terror planning and cooperation between security sector agencies.

Alternatively does the Government feel that a keeping a low profile is the most effective policy? At the very least we ask that the Government outlines its position on the threat posed by regional/global terrorism for further debate.

Casual Corruption in PNTL

There are many hard working members of the police who want to serve their community and their country. Unfortunately they are at risk of being drowned out by members who only want to serve themselves…

As part of its mission FM undertakes a number of community forums in different parts of the country. These meetings provide an opportunity for members of the community, community leaders and local civil society organizations to meet with PNTL members to discuss common security issues, learn about the security sector and raise and resolve problems. The meetings are mutually beneficial for all parties and both the community and police have acknowledged the advantages of building stronger relationships.

So when undertaking a community forum last week FM was somewhat surprised when a regional PNTL commander (jointly responsible for coordinating the meetings) asked us for a “tip”. When we refused his request was later repeated in terms of “money for fuel and Pulsa”, and yet again as “money for extra catering”. Perhaps the officer in question forgot what the role of FM is – as he most certainly forgot what his own role is!

With such obvious benefits for policing, it is a shame that some members of the PNTL view events fostering better communication with the community as a burden on their resources, or worse, an opportunity to profit themselves. Worse still is that in this instance it was a senior commander who seemed not to be aware of his responsibilities (what hope is there for those who serve under him?). It should come as no surprise that FM actually receives many complaints of this type of behaviour from junior officers who are frustrated with the ‘comfortable’ relationships and casual corruption of their superiors.

That’s not to say that the junior officers are themselves perfect. FM has heard of cases where members of the PNTL are asking victims of crime for the use of their cars in order to conduct their investigations. The apparent lack of PNTL vehicles is somewhat surprising considering the number of official PNTL motorcades that speed down the streets each day.

These incidents raise several questions for the PNTL command:

• Is there such a lack of resources within the PNTL that its members have to ask members of the public or civil society organisations for money and transport?

• Why don’t senior members of the force understand the difference between proper conduct and that which is corrupt or unprofessional? Is it that those promoted just aren’t suitable and qualified for their jobs?

• Why is it that junior officers have so little faith in internal complaints and anti-corruption systems that they turn to us with information rather than reporting it officially?

Further to these questions we ask that the PNTL takes the following actions:

1. Investigate our claims of corruption by a member of the PNTL.

2. Educate their members (and particularly leaders) on what is and is not appropriate behaviour in regards to corruption and professionalism.

3. Develop an effective and transparent internal complaints system that protects the informants and not the perpetrators of corruption.

4. Implement a zero-tolerance disciplinary system for those members still unable to act professionally.

The 2015 State General Budget for the Community Police Needs Political Support from the National Parliament

At the end of 2013, Fundasaun Mahein published a report entitled “The Basis of the Community Police Practice,” which discussed the services of community police and the Official Village Police (POV).

However, these initiatives, which involve community police services in 13 districts, have not yet received maximum attention from the government. The allocation of funding is still lacking, so the activitie of the community police in districts and villages still face various limitations in facilities, equipment, and training resources for member.

The government has submitted its proposed State General Budget to the National Parliament on October 2014, and this proposed budget will be discussed by each relevant commission of the National Parliament. Fundasaun Mahein views this proposal (2015 SGB) as evidence that the government is attentive to the funding needs of the community police. Moving forward, FM trusts that the national parliament will consider the difficulties and successes that community police have faced in the field thus far.

In mid-2014, the General Commander of the National Police of Timor-Leste (PNTL) and the supporting organizational donors for the community police held a workshop in Dili. This workshop discussed the various services of the community police. During the workshop, the donors presented a preliminary report, supported by an evaluation team that visited community police in villages, which explained that these posts are still facing shortages in the basic materials, such as facilities, equipment, and training resources, necessary to perform community police duties.
Through regional visits and discussions with community leaders, FM’s monitoring efforts have identified that these police face many problems, such as facilities, equipment, and lack of acknowledgment. Despite these shortages, whoever, the community police have achieved some successes.

As suggest above, FM believes that, in order to reach the strategic aims of the PNTL Strategy Plan for 2014-2018, the community police initiatives need support from the government and the national parliament. In particular, these initiatives need support for the action plan outlined in the proposed 2015 SGB, which would take effect in early 2015.

According to the PNTL Annual Plan, written in the proposed 2015 SGB, the community police will develop technical capacity and professionalism, as members of the PNTL, through internal training. Community policing activities will continue to provide training to POVs in villages, training for technical communication with POVs in villages, and training for volunteer security youth of villages in 13 districts. As such, these police members will play a profound role in social interactions and social psychology within these communities.

FM believes that these activities embody the philosophy of the PNTL, as well as the PNTL strategy Plan for 2014-2018, by adopting the ‘VIP Doctrine,’ which asks PNTL members to be ‘Visible, Involved, and Professional.’

FM believes that the National Parliament is well acquainted with the problems and successes of the community police initiatives thus far. Furthermore, FM believes that the National Parliament shares its concern for the visibility and policy adherence of community police in the field.

Recommendations:

1. The national parliament committee B should support policy and the allocation of funding for community police services in the upcoming budget discussion.
2. The national parliament must supervise the implementation of funds by the community police, if these funds are granted.

Committee B of the National Parliament Holds Hearings for the Proposed 2015 State General Budget for the Security Sector.

In October 2014, the government presented the proposed 2015 State General Budget (SGB) to the National Parliament (NP). This budget is in the hearing process by Commission B. This commission has urged Fundasaun Mahein to express its opinions regarding the proposed Law No. 16/III (3a) of the 2015 SGB. FM was invited to raise any opinions regarding the proposed 2015 SGB for the security sector.

According to the proposed 2015 SGB, $71,348,000 of the total $1.5 billion will be allocated to the MDS for administration. This amount does not include special funds or funds for development partners. The proposed amount does allocate funding for the internal institutions of the MDS, such as the Office of the MDS, the Secretary of State for Defense (SSD), the FALINTIL-F-FDTL, the IDN, the Secretary of State for Security (SSS) and the PNTL.

The opinions expressed by FM described the essential security areas, such as land, airspace, and maritime borders. The presentation also outlined the situation for immigration services and community security. All of these security areas continue to lack human resources, facilities, and equipment. Furthermore, there is minimal coordination and cooperation between the security institutions.

In relation to these essential areas, FM describes the difficulties of the relevant authorities. With these shortcomings in mind, it appears that the allocations of the proposed 2015 SGB would be beneficial in supporting and better equipping the security institutions. A specific theme of the presentation was that Timor-Leste need effective and further support for border security and training areas. In addition, resources should be devoted to increasing coordination between security authorities.

The maritime security area needs a system of maritime authority that is able to coordinate issues related to the sea. In particular, this maritime unit should engage with between defense agencies, security institutions, and the relevant ministries. FM’s monitoring identified that formal coordination processes have not been established between these authorities. Instead, this coordination occurs informally and only in the event of an accident or incident.

Another issue worth investigating is that of the immigration control system. Currently, the movements of migrants are increasing. In particular, Timor-Leste has witnessed the violation of migratory procedures by some citizens, such as those working with tourist visas and also illegal migrants. A significant problem is that Timor-Leste has no proper budget for deporting, so individuals found in violation of migratory procedures are simply assigned “abandoned volunteer” status.

FM’s presentation also focused on criminal investigations, for which the proposed 2015 SGB budget allocates funding. This funding specifically targets training and special instruction for investigators in drugs, human trafficking, and other areas in criminal investigation. Crime in today’s world has become organized and complex. Therefore, Timor-Leste needs qualified investigators to conduct services efficiently and effectively.

Another issue addressed was that of community security. Currently, these community initiatives are developing and involve all social structures within societies. One important development has been the rise of community policing through the Council of the Community Police (CCP) and volunteer security. CCP and volunteer security personnel have recently been placed in 74 villages and 8 districts. 3 other districts are in the consultation phase. These services will contribute strongly to the prevention of crime and conflict at the village level. Criminal activity prior to these services was very high, and security authorities are hoping that this new community-level enforcement will help abate crime.

Finally, FM’s presentation stressed the importance of greater state investment in intelligence activities. On this subject, FM recommended that greater coordination and cooperation be established between relevant security institutions, in order to combat the complex and evolving threats of today’s world.

Recommendations:

To Committee B of the National Parliament:

a) Support policy and budget allocation for essential services, such as border security, immigration control, maritime security, criminal investigation, community policing, and intelligence, in the coming budget discussion.

b) Supervise the execution of the 2015 SGB. This supervision should oversee the planning process, procurement, and project implementation. Committee B receives a large budget allocation for local visits ($73 million of the total $117 million reserved for goods and services), so it should perform appropriate follow-up during the entire implementation process.

To the MDS:

a) Establish a procurement calendar and calendar of acquisition for upcoming projects in the coming year, avoid urgent single-source procurement.

b) Obey procurement laws and guides of good practice during its execution of the 2015 SGB.

Security Force Vehicles are being used irresponsibly

For those living in Dili with a vehicle: navigating the traffic, potholes, unfinished roads and dodging the odd stray animal is a risky daily event. It can be shocking for even some of the most seasoned drivers in the world on how to react when faced with some of the risky maneuvers that are common place on the roads of Dili, this even more so when the car making these maneuvers is a police or military vehicle.

As well as witnessing this ourselves, we at Fundasaun Mahein are receiving more and more reports of FALINTIL-FDTL and Polisia Nasional Timor-Leste (PNTL) vehicles being driven and used in reckless and irresponsible ways, not only in Dili but also in the districts of Timor-Leste.

These incidences of reckless driving have been matched by an increase in security vehicles being crashed on the roads of Timor-Leste (see photo’s above). The most recent incident occurring only four days ago (3/11/14) when a special forces (BOM) SUV lost control, flipped over and crashed on the roads of Liquica. Because of the manner of this crash, FM strongly suspects the driver was going too fast or had did not have adequate knowledge on the basics of driving a car.

This incident is also concerning to FM as after the crash: groceries, shopping and fruit were observed in the car. These are hardly the tools of a crack special forces team and suggests that the car was being used in a way other than the stated military purpose of the vehicle.

It has become clear from these incidents that the security forces view the vehicles they receive as mere toys or a perk of their position. There seems to be very little ownership of the vehicles at an individual level and as a result security forces seem to be content to drive foolishly and recklessly confident in the knowledge that when they crash their vehicles the government will purchase them brand new ones. There is also little evidence that these vehicles are actually used to actually increase security; as mentioned in a previous blog FM has heard of cases where members of the PNTL are asking victims of crime for the use of their cars in order to conduct their investigations.

This has also become an issue of “do what we say, not as we do”. How are the driving conditions supposed to become safer for ordinary drivers when the rules being set by the security forces are constantly being flouted by the same security forces? Before the roads and traffic conditions get better the driving of the security forces must also improve.

Fundasaun Mahein recommends the following actions be taken by the commander of each unit

• That only officers that have a drivers license and demonstrated driving skills be authorised to drive official cars.

• That a code of conduct outlining the rules and responsibilities while driving an official vehicle be created and agreed to and signed by all officers authorised to drive.

• That any officer observed breaching the code of conduct or driving dangerously be immediately suspended from driving official vehicles or face other disciplinary measures.

• That official security vehicles be used only in an official capacity and are returned to the station at the end of each shift.

• That more is invested into the upkeep and maintenance of official vehicles so not as many new cars are purchased each year.
